§ 672.11 SAFETY OF DUMPSTERS.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      BARRICADE. Any type of structure at least four feet in height, having affixed to it a flashing amber lamp at a height of no less than three and one half feet, and bearing a reflectorized painted surface of at least five square feet.
      DUMPSTER. Any container suitable for the collection of building materials, debris or similar materials, which has a width of at least five feet, a length of at least five feet and a depth of at least three feet.
      LAMP. An amber colored signal lamp of sufficient intensity to be visible for a distance of at least 1,000 feet from the location of the amber colored signal lamp, but does not include an oscillating or rotating light.
      PUBLIC WAY. Includes all sidewalks, streets, thoroughfares and alleys located within the city.
   (B)   Between the period of sunset to sunrise, all dumpsters located in the city, on or within three feet of a public way, shall have reflectorized paint covering at least 50% of each side surface area on the dumpster and along each edge of all side surfaces of a width of not less than five inches.
   (C)   Between the period of sunset to sunrise, all dumpsters located in the city within three feet of a public way shall have at least one barricade erected within five feet of, and lateral to, each side of the dumpster which is within three feet of the public way.
   (D)   No person who, in whole or in part, owns a dumpster located in the city shall fail to comply with the requirements of this section.
   (E)   No person who deposits a dumpster or who causes a dumpster to be deposited on or within three feet of the public way in the city shall fail to either:
      (1)   Remove the dumpster from its location on or within three feet of the public way five days following the time the dumpster was deposited; or
      (2)   Be responsible for bringing the dumpster into compliance with the requirements of this section.
