§ 132.13 POSSESSION OF FIREARMS WHILE UNDER THE INFLUENCE OF INTOXICANTS.
   A.   Firearm. A “firearm” is a weapon from which a shot or projectile is discharged by force of a chemical explosive such as gunpowder.
   B.   Within the corporate limits of the Town of Bernice, and in any other area over which the Town is authorized to exercise jurisdiction, it shall be unlawful for any person to carry or use a firearm in any circumstances while under the influence of beer, intoxicating liquors, hallucinogenic, or any unlawful or unprescribed drug, and it shall be unlawful for any person to carry or use a firearm when under the influence of any drug prescribed by a licensed physician if the aftereffects of such consumption affect mental, emotional, or physical processes to a degree that would result in abnormal behavior.
