A. Definitions. The following definitions shall apply to this section unless the context clearly indicates or requires a different meaning:
1. A FIREARM is a weapon from which a shot or projectile is discharged by force of a chemical explosive such as gunpowder.
2. An OFFENSIVE WEAPON is defined as any implement likely to produce death, bodily harm, or fear of death or bodily harm in the manner it is used or attempted to be used.
B. Within the corporate limits of the Town of Bernice, and in any other area over which the Town is authorized to exercise jurisdiction, it shall be unlawful for any person to carry any firearm or offensive weapon, whether concealed or unconcealed, into any of the following places within the Town of Bernice, or in any other area over which the Town is authorized to exercise jurisdiction:
1. Any structure, building, or office space which is owned or leased by the Town of Bernice or Bernice Public Works Authority for the purpose of conducting business with the public;
2. Any public or private elementary or secondary school, except as otherwise provided under Oklahoma law;
3. Any publicly owned or operated sports arena or venue during a professional sporting event, unless allowed by the event holder and authorized by Oklahoma law;
4. Any place where gambling is authorized by law, unless allowed by the property owner and authorized by Oklahoma law;
5. Any property adjacent to a structure, building, or office space in which the carrying of a concealed or unconcealed firearm is prohibited by this section; or
6. Any other place specifically prohibited by Oklahoma law or federal law.
C. The provisions of this section shall not apply to:
1. Any peace officer or other person authorized by law to carry a firearm in the course of employment;
2. Private investigators with firearms authorization when acting in the course and scope of employment; or
3. Elected officials of a county, who are in possession of a valid handgun license issued pursuant to the provisions of the Oklahoma Self-Defense Act, when acting in the performance of his or her duties within the courthouses of the county in which he or she was elected.
