No person lawfully in custody or confined in jail, before or after conviction for any violation of the ordinances of the town, or held in custody going to jail, or working upon the streets or other public grounds of the town or in custody of any officer of the town, shall break or attempt to break jail or custody, and escape or attempt to escape therefrom.
