§ 130.09 AUTHORITY TO ISSUE TICKET OR CITATION.
   (A)   Ticket or citation.
      (1)   Except where otherwise specifically required by ordinance, any police officer or other person charged with enforcing any town ordinance may proceed as provided in this section upon discovering a violation of an ordinance. The officer or other person enforcing a town ordinance may issue a ticket on forms prepared by the Chief of Police.
      (2)   The ticket or citation shall include, at a minimum, the following information:
         (a)   The date of the alleged violation;
         (b)   The nature of the alleged violation. If a person is accused of violating a speed limit, the ticket shall set forth the applicable speed limit and the alleged actual speed of the subject vehicle;
         (c)   The place where the alleged violation took place;
         (d)   The number of the ordinance and section violated;
         (e)   The date, time and place when the matter will be heard in Municipal Court;
         (f)   Where town policy permits, the ticket shall contain a statement that, in lieu of appearing in court, the person receiving the ticket may pay the ticket by mail or in person on or before the court date; and
         (g)   The name of the person issuing the ticket.
   (B)   Warning ticket. Instead of issuing a ticket for a traffic violation or other ordinance violation, any police officer or other person enforcing a town ordinance may issue a warning ticket. The warning ticket shall contain the information required in divisions (A)(2)(a) through (A)(2)(d) and (A)(2)(g) above. No court appearance and no fine shall be involved in any warning ticket. A warning ticket may be issued only when it appears that the offense will not be repeated and that the violation was unintentional.
