§ 33.21 ARP LOCAL FISCAL RECOVERY FUND.
   (A)   Fund established. There is hereby established the ARP Local Fiscal Recovery Fund (Fund 176), in accordance with the directives of the Indiana State Board of Accounts.
   (B)   Sources of funding. The source of funding includes monies allocated to the city from the American Rescue Plan Act of 2021, and distributed to the city in 2021 and 2022.
   (C)   Use of funding.
      (1)   Pursuant to Section 603(c) of the Social Security Act, and as added by Section 9901 of the ARP, the city shall only appropriate and use the funds to cover costs incurred by the city by December 31, 2024 for the following:
         (a)   To respond to the public health emergency with respect to the Coronavirus Disease 2019 (COVID-19) or its negative economic impacts, including assistance to households, small businesses, and not-for-profits,or aid to impacted industries such as tourism, travel, and hospitality;
         (b)   To respond to workers performing essential work during the COVID-19 public health emergency by providing premium pay to eligible workers of the city that are performing such essential work, or by providing grants to eligible employers that have eligible workers who perform essential work;
         (c)   For the provision of government services to the extent of the reduction in revenue of the city due to the COVID-19 public health emergency relative to revenues collected in the most recent full fiscal year of the city prior to the emergency; or
         (d)   To make necessary investments in water, sewer, or broadband infrastructure.
         (e)   For any other purpose as designated and/or approved by the United States Department of Treasury from time to time.
      (2)   The Common Council shall adopt a plan which provides details for the use of said funds. Any grants or programs to respond to the public health emergency or its negative economic impacts under Section 603(c)(1)(A) should be through written agreement with the recipient. Disbursements to grantees and program recipients must be documented and in compliance with the written agreement. Premium Pay must comply with Section 601(c)(1)(B) and is defined in Section 602(g) and limited to work during the COVID-19 public health emergency, and internal controls must be designed, implemented, and documented to provide reasonable assurance that the ARP funds will be safeguarded and used in accordance with the ARP.
   (D)   Amendments. This section may be amended from time to time if additional guidance is received from any federal or state agency regarding the funding and/or use of said funds.
   (E)   Termination and nontransferability. The ARP Local Fiscal Recovery Fund (Fund 176) shall exist until terminated by ordinance of the Common Council. Moneys from said Fund shall at no time be transferred to any other fund of the city.
