11-2-3: PRELIMINARY PLAT:
   A.   After meeting informally with the village administrator, the subdivider shall cause to be prepared a preliminary plat prior to the making of any street improvements or the installation of any utilities. The preliminary plat shall meet the standards of design as set forth in this title, and shall show the following information: (Ord. 05-02, 1-18-2005; amd. 2016 Code)
      1.   Scale of one hundred feet to one inch (100' = 1") or larger.
      2.   Name of subdivision, names and addresses of the owners, the engineer or surveyor, and the owners of the adjacent property.
      3.   Location of subdivision by section, township, range or other legal description, together with small scale sketch showing location within the section.
      4.   Date, approximate north point and graphic scale.
      5.   Acreage of land to be subdivided.
      6.   Zoning classification of lands to be subdivided and all adjacent lands.
      7.   Contours at an interval of not greater than two feet (2') or at lesser intervals if deemed necessary by the planning and zoning commission.
      8.   Boundary lines of area to be subdivided and their bearings and distances.
      9.   Existing and proposed easements and their locations, widths and distances, and identification of all village easements for water mains, sanitary sewers, storm sewers, and/or overland storm drainage routes as well as for all utility easements for gas, electric, telephone and cable television.
      10.   Streets on and adjacent to the tract and their names, widths, approximate grades and other dimensions as may be required.
      11.   Utilities on and adjacent to the tract showing proposed conditions to existing utility systems. Rear easements for utility poles and wires shall be provided wherever possible.
      12.   Lot lines and lot numbers.
      13.   Sites and their acreages, if any, to be reserved or dedicated for parks, playgrounds, schools or other public grounds; sites, if any, for semipublic, commercial or multi-family uses.
      14.   Minimum building setback lines.
      15.   Location of railroads, drainage courses, permanent buildings or other structures and wooded areas.
      16.   Other reasonable information, such as soil tests, if so requested by the commission in order to make a proper review of the site.
      17.   Copies of proposed deed restrictions, if any, shall be attached to the preliminary plat.
   B.   1. A subdivider shall present twenty (20) copies of a preliminary plat and supplementary material to the village engineer, along with a written application for conditional approval of same. Simultaneously, the subdivider shall file copies of same with any or all of the following, as appropriate:
         a.   The Illinois department of transportation with respect to roadway access where such access is a state highway;
         b.   The relevant local highway authority with respect to all other roadway access; or
         c.   The county health department with respect to sewage disposal systems if any part of the platted land will not be served by a public sewer system. (Ord. 05-02, 1-18-2005)
      2.   The subdivider shall request that each department or authority listed above review the application based solely upon safety or access control standards and shall request that the department or authority provide written approval or disapproval, and if disapproval, the reasons therefor along with improvements that would remove the disapproval, to the planning and zoning commission and village board of trustees not later than ninety (90) days from the date the application is received.
   C.   The preliminary plat shall not be forwarded to the planning and zoning commission until it receives approval by the village engineer.
   D.   The village administrator shall submit a copy of the preliminary plat to the following: (Ord. 05-02, 1-18-2005; amd. 2016 Code)
      1.   Proviso Township supervisor;
      2.   School district 87, school district 93, and school district 209;
      3.   Berkeley park district and/or other appropriate park districts; and
      4.   Appropriate agencies providing sewer and water services, if other than the village. (Ord. 05-02, 1-18-2005)
   E.   The village administrator, when submitting the copy of a preliminary plat to the above, shall request that each return a copy of the preliminary plat, along with notations and recommendations, within fourteen (14) days of receipt of said preliminary plat.
   F.   The planning and zoning commission shall approve, disapprove or approve subject to modification the said preliminary plat within ninety (90) days from the date of the application or the date of filing by the applicant of the last item of required supporting data, whichever date is later, unless such time is extended by mutual consent.
   G.   If a preliminary plat is disapproved, then, within said ninety (90) days, the planning and zoning commission shall furnish to the applicant a written statement setting forth the reasons for such disapproval.
   H.   If a preliminary plat is approved subject to modifications, then, within said ninety (90) days, the planning and zoning commission shall furnish to the applicant a written statement specifying the nature of the required modifications.
   I.   If a preliminary plat is approved by the planning and zoning commission, the original plat and two (2) prints or copies of the preliminary plat shall be endorsed by the planning and zoning commission as follows:

   J.   The action of the planning and zoning commission shall be noted on three (3) copies of the preliminary plat with any notations made at the time of approval or disapproval of the specific changes required. The original of the preliminary plat, so endorsed, shall remain on file with the planning and zoning commission. One copy, so endorsed, shall be returned to the subdivider, and one copy, so endorsed, shall be forwarded to the village administrator.
   K.   If a preliminary plat is approved by the planning and zoning commission, the board of trustees shall accept or reject said plat, by resolution duly adopted, within thirty (30) days after its next regularly scheduled meeting following the action of the planning and zoning commission.
   L.   The village clerk shall attach a certified copy of the resolution of approval or disapproval to a copy of the preliminary plat. If the preliminary plat is disapproved, the resolution shall state the reasons for the disapproval. A copy of the resolution shall be filed in the office of the village clerk.
   M.   Approval of the preliminary plat shall not constitute acceptance of the final plat and shall not qualify a plat for recording. The approval of the preliminary plat shall lapse unless a final plat based thereon is submitted to the village within one year from the date of such approval in the manner specified in this chapter.
   N.   A charge shall be made for the examination and approval or disapproval of every preliminary plat reviewed by the planning and zoning commission. At the time a preliminary plat is submitted for approval, the subdivider shall also submit a check payable to the village of Berkeley according to the annual fee ordinance. The subdivider submitting a preliminary plat shall be responsible for all fees incurred by the village pertaining to legal, engineering and land planning expenses incurred by the village as a result of the submission of said preliminary plat.
