9-2-1: WATER SUPPLY:
   A.   Joint Use Of Hillside Water:
      1.   Purpose: It is necessary and in the best interests of the village that it acquire and operate jointly with the village of Hillside a common source of supply of water in order that sufficient water for the use of the village and its inhabitants for public and domestic purposes be available at all times, and that it acquire and operate jointly with the village of Hillside a common source of supply, said method being that most economical method of acquiring a complete and sufficient supply of water. (1976 Code § 13.12.010)
      2.   Joint Operation: Pursuant to the terms of 65 Illinois Compiled Statutes 5/11-135-1 et seq., the village president and board do hereby elect and determine to acquire and operate jointly with the village of Hillside a common source of supply of water.       3.   Berkeley-Hillside Water Commission: As soon after August 2, 1948, as may be, and pursuant to the terms of the act referred to in subsection A2 of this section, the village president is authorized and directed, with the approval of the board, to appoint a commissioner to act as a member of the commission to be hereafter organized and known as the Berkeley-Hillside water commission, with the powers and duties as prescribed in the act referred to in subsection A2 of this section.    B.   Groundwater As Potable Water Supply:
      1.   Definitions:
         PERSON: Any individual, partnership, copartnership, firm, company, limited liability company, corporation, association, joint stock company, trust, estate, political subdivision, or any other legal entity, or their legal representatives, agents or assigns.
         POTABLE WATER: Any water used for human or domestic consumption, including, but not limited to, water used for drinking, bathing, swimming, washing dishes, or preparing foods.
      2.   Use Prohibited: The use or attempt to use as a potable water supply groundwater from within the corporate limits of the village by the installing or drilling of wells or by any other method is hereby prohibited. (Ord. 03-44, 7-15-2003; amd. 2016 Code)
