8-3-10: PROTECTION OF TREES:
   A.   Damage To, Removal, Attaching Objects: Unless specifically authorized, no person shall damage, cut, carve, transplant or remove any tree from a public street or parkway, or from any other municipally owned property. Further, unless specifically authorized by the village superintendent of public works, no person shall attach any rope, wire, nails, advertising posters or other contrivance to any such tree, allow any gaseous liquid or solid substance which is harmful to such trees to come in contact with them or set fire or permit any fire to burn when such fire or the heat thereof will injure any portion of any tree located on publicly owned land or dedicated right of way.
   B.   Fencing During Construction Or Excavation:
      1.   All trees on any street, parkway or other municipally owned property near any excavation or construction of any building, structure, or street work shall be guarded by those doing any such excavation or construction work with a substantial barrier, approved by the village, at a distance in feet from the tree equal to the diameter of the trunk in inches dbh (as measured 4.5 feet aboveground). All building material, dirt or other debris shall be kept outside said barrier.
      2.   No person shall excavate any ditches, tunnels or trenches or lay any driveway or sidewalk within a distance in feet from any tree on any street, parkway or other municipally owned property equal to the diameter of the trunk in inches dbh (measured 4.5 feet aboveground) without first obtaining a written permit from the superintendent of public works.
   C.   Materials Obstructing Growth: No person shall deposit, place, store or maintain upon any public place of the village any stone, brick, sand, dirt, sod, concrete or other materials which may impede the free passage of water, air and fertilizer to the roots of any tree growing thereon, except with prior written permission of the superintendent of public works.
