4-2-13: REGULATIONS REGARDING VIDEO GAMING TERMINALS:
   A.   State Approval And County And Village Permit Stickers Required:
      1.   It shall be unlawful for the licensee of any licensed premises to operate a video gaming terminal who has not also obtained approval for the operation of the video gaming terminals from the State of Illinois, from Cook County, and who has not obtained a video gaming terminal establishment permit sticker and a video gaming terminal operator permit sticker for each video gaming terminal from the village.
      2.   It shall be unlawful for a video gaming terminal operator to own, service, maintain or place a video gaming terminal in the village who has not also obtained a license for the ownership, service, maintenance and/or placement of each video gaming terminal in the village from the State of Illinois, and who has not also obtained a video gaming terminal operator permit sticker from the village for each video gaming terminal.
   B.   Regulations For Licensed Establishments: Regulations governing licensed establishments operating video gaming terminals are as follows:
      1.   A valid village video gaming terminal establishment permit sticker and a valid village video gaming terminal operator permit sticker shall be clearly displayed at all times on each video gaming terminal.
      2.   No more than the lesser of the maximum amount of video gaming terminals allowed by Illinois law or the amount of video gaming terminals allowed in the village-issued supplemental video gaming establishment permit may be located on the licensed establishment's premises.
      3.   All video gaming terminals must be located in an area restricted to persons twenty one (21) years of age or older. The entrance to such an area must at all times be within the view of at least one employee who is at least twenty one (21) years of age. Video gaming terminals must not be visible from any area outside of the building.
      4.   No licensed establishment may cause or permit any person under the age of twenty one (21) to use, play or operate a video gaming terminal.
      5.   No video gaming terminal may be played except during the legal hours of operation allowed for the consumption of alcoholic beverages at the licensed premises.
      6.   The licensed establishment must fully comply with the Illinois video gaming act and all rules, regulations, and restrictions imposed by the Illinois gaming board, as may be amended from time to time, which are hereby incorporated by reference into this chapter.
      7.   The licensed premises shall be video recorded pursuant to this chapter.
      8.   Any violation of this section shall be cause for the immediate suspension of the liquor license for the licensed premises, and such suspension shall remain in effect until the licensee demonstrates that he is in full compliance with this section.
      9.   Any licensee that has had his or her license revoked or suspended by the village or by the Illinois State Liquor Control Commission or has his or her video gaming license revoked or suspended by the Illinois gaming board shall automatically have his or her village-issued supplemental video gaming establishment permit and village-issued video gaming terminal establishment permit stickers revoked or suspended for the same time period as his or her liquor and/or gaming board permit sticker suspended, whichever the case may be.
      10.   Every video gaming terminal that does not have a valid video gaming terminal establishment permit sticker issued by the village, a valid video gaming terminal operator permit sticker issued by the village, and authorization from the state of Illinois, or that is operated in violation of this section or is otherwise unlawful, shall be considered a gambling device subject to seizure and shall be turned over to the Illinois Gaming Board in accordance with Board regulations and applicable laws unless otherwise ordered by a court of competent jurisdiction.
      11.   Every licensee shall submit a written statement to the village with the identities and addresses of the video gaming terminal operators owning, placing, serving and/or maintaining video gaming terminals at the licensed premises prior to the video gaming terminal operator owning, placing, serving and/or maintaining any video gaming terminal at the licensed premises.
   C.   Regulations For Video Gaming Terminal Operators: Regulations governing video gaming terminal operators are as follows:
      1.   A valid village video gaming terminal operator permit sticker shall be clearly displayed at all times on each of the video gaming terminal operator's video gaming terminals in the village.
      2.   A video gaming terminal operator must fully comply with the Village Code, the Illinois Video Gaming Act and all rules, regulations, and restrictions imposed by the Illinois Gaming Board, as may be amended from time to time, which are hereby incorporated by reference into this chapter.
      3.   Any violation of this section shall be cause for the immediate suspension of any license issued to the video gaming terminal operator and any video gaming terminal operator permit stickers issued by the village to the video gaming terminal operator.
      4.   Any video gaming terminal operator that has had his or her video gaming license revoked or suspended by the Illinois Gaming Board shall automatically have his or her village-issued supplemental video gaming operator permit and village-issued video gaming terminal operator permit stickers revoked or suspended for the same time period as his or her Illinois Gaming Board revocation or suspension, as the case may be.
