A. Any applicant for a license or franchise pursuant to chapter 3 or 4 of this title shall pay a fee as established in the annual fee schedule or a percentage of the estimated cost of the applicant's proposed telecommunications facilities, as certified by the applicant's professional engineer and as established in the annual fee schedule, whichever is greater.
B. The application and review fee shall be deposited with the village as part of the application filed pursuant to chapter 3 or 4 of this title.
C. An applicant whose license or franchise application has been withdrawn, abandoned or denied shall, within sixty (60) days of its application and review fee written request, be refunded the balance of its deposit under this section, less:
1. An amount as established in the annual fee schedule.
2. All ascertainable costs and expenses incurred by the village in connection with the application. (Ord. 96-10, 5-7-1996; amd. 2016 Code)
