§ 53.001 RESERVED
§ 53.002 DISCHARGING WEAPONS PROHIBITED
   (A)   It shall be unlawful for any person to shoot or discharge, within the city, any firearm, pellet gun or rifle, air-rifle or gun, or BB-rifle or gun, unless necessary or proper for the protection of person or property; provided, however, that this provision shall not apply to peace officers who discharge weapons in the performance of their lawful duties; and provided further that this provision shall not apply in any area with a zoning classification of A-1 (Agriculture).
   (B)   Upon the conviction of any person for the violation of this section, any gun or rifle used by a person in the commission of an offense may be confiscated and disposed of in compliance with Kentucky Revised Statutes.

§ 53.003 OBSTRUCTING STREETS, SIDEWALKS PROHIBITED
   No person shall assemble, congregate or use any public street or public sidewalk in the city so as to impede or hinder the orderly and normal traffic or travel of any vehicle, or passenger therein or any pedestrian, along, upon or about the street or sidewalk.

§ 53.004 PEDDLING OF FOOD PROHIBITED ON STREET OR ALLEY, EXCEPTIONS
   (A)   It shall be unlawful for any person to sell, peddle, or barter any goods, wares, merchandise, fruits, vegetables and produce of every kind and description, from any truck, automobile, or stand located on any public street or alley in the city, except as provided in subsection (B).
   (B)   The sale of home-grown vegetables and produce from house to house by a farmer or grower, is hereby exempt from the provisions of this section. The mayor may also exempt the application of this section upon written request to the mayor that an event of charitable, civic, or education significance is occurring and that as a part of the event there will be event related items and services sold by merchants which are necessary and connected to the event, and upon the mayor's certification of same and that the public interest shall be served by a waiver.

§ 53.005 RESERVED
§ 53.006 OPEN BURNING PROHIBITED; PERMIT FEE
   (A)   No person shall cause, suffer or allow any only burning of any material within the corporate limits of the city unless such person obtains a burning permit issued by the city fire department. No burning permit shall be issued unless it is in compliance with 401 KAR 63:005, and all persons issued burning permits shall comply with 401 KAR 63.005.
   (B)   An applicant for a burning permit may receive two (2) free burning permits each calendar year, per address; thereafter, each applicant shall be charged the sum of ten ($10.00) dollars per permit.
   (C)   Any person who violates the provisions of this section shall be guilty of a violation and shall be subject to a fine of not less than twenty-five ($25.00) dollars nor more than one hundred fifty ($150.00) dollars for each offense.
