§ 40.505 ADDITIONAL REGULATIONS; ANNUAL REPORT
   Transportation in commerce through the city of the materials identified in (A), (B) and (C) below in the quantities indicated shall be subject to the regulations set forth in §§ 40.506 through 40.510 in addition to those regulations adopted in §§ 40.500 through 40.503 . Except that, for truck shipments of radioactive materials listed in (C) below, the provisions of § 40.506(D)(5), below shall not apply. (Numbers in parentheses refer to sections of Title 49 of the Code of Federal Regulations.)

   (B)   Flammable liquids. Transported in quantities of one thousand (1,000) gallons or more with flash points of seventy-three (73) degrees Fahrenheit or less as determined by tests listed in 49 CFR (173.115(d)) with the exception of distilled spirits of one hundred forty (140) proof or less (173.115(a)(2)), and with exception of gasoline being delivered by vehicles with a state or federal permit.
   (C)   Radioactive materials.
      (1)   Plutonium isotopes in any quantity and form exceeding two (2) grams or twenty (20) curies whichever is less;
      (2)   Uranium enriched in the isotope U-235 exceeding twenty-five (25) atomic percent of the total uranium content in quantities where the U-235 content exceeds one kilogram;
      (3)   Any of the actinides (i.e., elements with atomic number 89 or greater) the activity of which exceeds twenty (20) curies;
      (4)   Spent reactor fuel elements or mixed fission products associated with the spent fuel elements the activity of which exceeds twenty (20) curies; or
      (5)   Any quantity of radioactive material specified as a "Large Quantity" by the Nuclear Regulatory Commission in 10 CFR Part 71, entitle "Packaging of Radioactive Material for Transport."
   (D)   The fire chief is authorized to collect all available information on the volumes, routes, risks, and conditions of transport of these hazardous materials presenting the highest risk and to report annually to the council on the transportation of hazardous materials and the adequacy of emergency response capabilities in case of accident.
