(a) Before any person is granted a permit for the construction, enlargement, alteration, repair or removal of any dwelling, building or other structure which may result in damage to a municipal street, highway, sidewalk, tree lawn, gutter or utility, each person shall be required to pay a road damage fee as specified in Chapter 1428 of these Codified Ordinances.
(b) If the fee paid is insufficient to reimburse the municipality for damage actually caused, the Village Treasurer may take the necessary steps to affect the collection of the remainder of the costs from the person or entity which caused the damage.
(c) The Planning Commission, upon application and for good cause shown, may reduce or waive the road damage fee to avoid an unjust or inequitable result.
(d) The Village shall deposit all fees collected pursuant to this section in the Village's Street Fund, and such fee shall be used for repair of the Village's roads and appurtenances, and for no other purpose.
