A. Street Obstructions: The streets, sidewalks and alleys of the Village shall be kept free and clear of all obstructions, encumbrances and encroachments for the use of the public, and shall not be used or occupied in any other way than is provided in this Code. (1976 Code § 6.05)
B. Building Materials Or Other Objects:
1. No person shall encumber or obstruct any street, sidewalk or alley in the Village by placing thereon any building materials or any article or thing without having first obtained written permission from the Director of Public Works. (Ord. 36-78, 11-16-1978)
2. No person shall place any object, except mailboxes and requisite posts, in a public parkway unless it will break away in a controlled manner during an impact with a motor vehicle which has left the roadway.
Any rock, boulder or other decorative object installed on any portion of the public parkway in violation of this Section shall be relocated or removed within thirty (30) days after written notice from the Department of Community Development. (Ord. 46-94, 10-4-1994)
C. Contractors In Streets: All persons who do work in any sidewalk, street or other thoroughfare in the Village shall have all sand, dirt and rubbish cleared off the sidewalk, street or thoroughfare after the work is completed. (1976 Code § 6.07)
D. Contractors Obstructing Streets: It shall be lawful for persons employed to repair or pave any street in the Village to place an obstruction across such street or roadway for the purpose of preserving the part so repaired or made until the same shall be fit for use, leaving at all times a sufficient passage for pedestrians. No person shall, without the consent of the Director of Public Works or the person superintending such paving, remove any such obstruction. No person repairing or paving a street shall obstruct more than the space of one block and one intersection at the same time in any street, or keep the same blocked for more than two (2) days after the roadway is finished. (1976 Code § 6.08)
E. Fencing And Lights: It shall be the duty of every person doing work in any street, alley or sidewalk or depositing materials thereon, where such work is left exposed and would be dangerous to the public, to erect a fence or railing at such excavations or work in such a manner as to prevent danger to persons who may be traveling on such streets. It shall be the duty of such person to place upon such railing or fence suitable sufficient lights through the night during the performance of said work. (1976 Code § 6.09)
F. Removal Of Obstructions: The Director of Public Works or any police officer may order any article or thing which may encumber or encroach upon or obstruct any street, alley or sidewalk to be removed. If such article or thing shall not be removed within the time specified in the notice to the owner or person in charge thereof to remove the same, or if the owner cannot be readily found for the purpose of such notice, the Director of Public Works or police officer shall cause the same to be removed to some suitable place to be designated by the Director of Public Works. The expense of such removal may be recovered from the person causing such obstruction. (1976 Code § 6.10)
