A. Compensation For An Injury In Line Of Duty: The village will provide salary compensation to any full time sworn member of the police department or the police chief who was injured in the line of duty in accordance with the provisions of the public employee disability act, 5 Illinois Compiled Statutes 345/0.01 et seq.
B. Assumption Of Liability For Medical Expenses: In case of an accident resulting in an injury to, or death of, any full time sworn member of the police department or police chief while in the employ of the village while in the performance of his duties, the village manager may secure and provide proper medical care and hospital treatment for any such full time sworn member of the police department or police chief and to that end may incur expense in connection therewith to be paid from funds budgeted or appropriated therefor by the village board or from proceeds of insurance funds.
C. Investigation Of Facts: It shall be the duty of the village manager to make a complete investigation of all facts surrounding any accident resulting in an injury to, or death of, any full time sworn member of the police department or police chief in the employ of the village while in the performance of his duties, to obtain the statement of all material witnesses and to present a report thereof. Such report shall also show the date and hour of any such accident, the place of occurrence of same, the names and addresses of witnesses, the apparent nature and extent of the injury and whether the injury or death was caused under circumstances creating a legal liability for damages on the part of some person other than the village. D. Payment Of Expenses: All bills showing the items of expense incurred for any medical care and hospital treatment referred to in subsection B of this section shall be presented to the village manager, who shall determine the reasonableness of the charges made for the services so rendered and recommend payment to cover the items of expense. E. Reimbursement By Third Person: If the village manager is of the opinion that any accident referred to in this section created a legal liability for damages on the part of some person other than the village, it shall be the duty of the village manager to demand from such person reimbursement to the village for the amount expended by the village for the medical care and hospital treatment of any such full time sworn member of the police department or police chief. In default of payment of such amount so expended, the village manager may cause proceedings to be filed to recover for the village the amount so expended. (Ord. 22-96, 5-21-1996; amd.
