GENERAL PROVISIONS
(A) There is hereby established a Municipal Court which shall be a part of the unified judicial system of the state. (‘88 Code, § 7.101)
(B) The Court shall have jurisdiction to try and determine all cases arising under the ordinances of the city and shall have all judicial powers and duties as are conferred by the laws of the state. The Court shall have all powers, duties and jurisdiction in criminal cases as are now conferred by law upon magistrates appointed and commissioned in this county. The Court shall not have the authority of a magistrate to appoint a constable. It shall have no jurisdiction in civil matters. (‘88 Code, § 7.102)
(A) The Court shall be presided over by the City Judge who shall be appointed by the Council for a term not to exceed four years and shall receive compensation as determined by Council. Before entering upon the discharge of the duties of his office, he shall take and subscribe the oath of office prescribed by Article VI, Section 5, of the South Carolina Constitution. The Judge shall not be required to be a resident of the city. (‘88 Code, § 7.103)
(B) The Council may appoint a competent person as Acting Judge during the absence, sickness, incapacity or other disqualification of the City Judge. (‘88 Code, § 7.104)
(C) The Council may contract with Marlboro County for Municipal Judge service.
