§ 95.02 PLACING TABLES, GLASS AND THE LIKE ON STREETS.
   (A)   It shall be unlawful for any person to erect or maintain any stand, booth, table or other thing upon any sidewalk or street of the city, for the purpose of selling or offering for sale any goods, wares, merchandise, fruit, vegetables, fish, meats or other commodities except with an approved sidewalk encroachment permit and proof of liability insurance as follows: (‘88 Code, § 15.102)
      (1)   Sidewalk encroachment permit fee shall be $50 for mechandise, tables, and chairs. Approved planters are exempt from payment.
      (2)   Proof of insurance: a minimum of $600,000 per occurrence for property damage and $1,000,000 for bodily injury.
      (3)   Permitter/organization hereby shall assume all risks incidental to or in connection with the permitted activity and shall be solely responsible for damages, or injury, of any nature to person or property, directly or indirectly in connection with the permitted activity or conduct of permittee’s operation.
      (4)   Permitter hereby expressly agrees to release the city of any penalties resulting in violation of law, ordinance, or regulation affecting its activity and from all claims, suits, property damage, or injuries directly or indirectly arising out of or in connection with the permitted activity and further agrees to release, hold harmless, and indemnify the city of all claims, suits, or the conduct of its operation resulting from the negligence or intentional acts or omission of permittee or its officers, agents, and employees.
      (5)   A pedestrian clearance shall be five feet and all sale merchandise shall be removed from the sidewalk after business hours, except for approved benches, planters and/or outdoor dining sets.
   (B)   (1)   No person shall throw or deposit upon any street any glass bottle, glass, nails, tacks, wire, cans or any other substance likely to injure any person, animal or vehicle upon the street.
      (2)   Any person who drops or permits to be dropped or thrown upon any street any destructive or injurious material shall immediately remove the material or cause it to be removed.
      (3)   Any person removing a wrecked or damaged vehicle from a street shall remove any glass or other injurious substance dropped upon the street from the vehicle.
