§ 112.32 GRANT OF AUTHORITY.
   There is hereby granted to the company, its successors and assigns, for a period of 25 years from the date of acceptance of this subchapter, as hereinafter provided, the right and authority to offer telecommunications service and establish, construct, operate, and maintain a telecommunications system or to provide similar facilities or properties rented or leased from other persons, firms, or corporations, including, but not limited to, any public utility, the city, or other person, group, or entity permitted to do business in the city, within the corporate limits of the city upon the terms and conditions contained herein; and such company is further granted the right and authority with this grant of power to construct, erect, operate, enlarge, extend, repair, and maintain in, upon, along, across, above, over, and under the streets, alleys, and public ways now laid out or dedicated, and all extensions and additions thereto within the corporate limits of the city, all poles, wires, cables, underground conduits, conductors, fixtures, and other equipment necessary for the establishment, operation, and maintenance of a telecommunications system or offering of telecommunications services. The authority and franchise granted by the city to the company herein shall be without fee or assessment against the company and the city hereby agrees that during the term of this franchise the city shall not assess or otherwise charge the company a franchise fee, tax, or other assessment for the construction or operation of a telecommunications system, offering of telecommunications service, or other authority granted herein.
