For the purpose of this subchapter the following terms, phrases, words, and their derivation shall have the meaning given herein. If consistent with the context, words used in the present tense shall include the future, words in the plural shall include the singular number, words in the singular number shall include the plural, words used denoting the masculine shall also denote the feminine, and words used denoting the feminine shall also denote the masculine. The word “shall” shall always be mandatory and not merely directory.
CITY. The political subdivision of the State of Nebraska commonly known as Benkelman, Dundy County, Nebraska, a municipal corporation.
COMPANY. The Benkelman Telephone Company, Inc., a Nebraska corporation, duly incorporated and doing business in the State of Nebraska.
COUNCIL. The municipal governing body of Benkelman, Dundy County, Nebraska and as such body being the legislative body of Benkelman, Dundy County, Nebraska.
PERSON. Any person, firm, partnership, association, corporation, company, entity, or organization of any kind.
TELECOMMUNICATIONS. The transmission, between or among points specified by the user, of information of the user’s choosing, without change in the form or content of the information as sent and received.
TELECOMMUNICATIONS SERVICE. The offering of telecommunications for a fee directly to the public, or to such classes of users as to be effectively available directly to the public, regardless of the facilities used.
