§ 53.01 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   HAZARDOUS WASTE. Any solid waste which because of its quantity, concentration, or physical, chemical, or infectious characteristics may cause or significantly contribute to an increase in mortality or an increase in serious irreversible, or incapacitating reversible, illness or pose a substantial present or potential hazard to human health or the environment when improperly treated, stored, transported, disposed of, or otherwise managed, as further defined in N.A.C. Title 128. HAZARDOUS WASTE shall not include household hazardous wastes exempt from regulations under the Environmental Protect Act.
   SOLID WASTE. All garbage, trash, rubbish, or refuse commonly generated by residential, commercial, industrial, institutional, or governmental activities, including solids, liquids, semi-solid, or contained gaseous material.
   YARD WASTE, LEAD-ACID BATTERIES, WASTE OIL, WASTE TIRES NOT PROPERLY PROCESSED, HOUSEHOLD APPLIANCES, UNREGULATED HAZARDOUS WASTE, AND CONSTRUCTION AND DEMOLITION WASTE. Defined according to N.A.C. Title 132.
