§ 50.15 EMERGENCY RESTRICTIONS ON USE OF WATER.
   (A)   In order to provide equal water service for all customers and a water reserve for firefighting purposes, the city shall have the right to suspend/ration the use of water for all recreational purposes, fountains, lawns, playing fields, personal swimming pools, flower gardens and vegetable gardens, or for any other purpose, whenever in the opinion of the Mayor or City Utility Superintendent the public exigency may require it. The Mayor or City Utility Superintendent is authorized and empowered to declare the existence of an emergency relating to the available water supply of the municipal water system, and to impose restrictions on the use of water during such emergency. Whenever the Mayor or City Utility Superintendent shall determine that the remaining available water supply is critically low, from whatever cause, the Mayor or City Utility Superintendent may declare the existence of an emergency and impose reasonable restrictions on the use of such water. It shall be unlawful for any person to fail to observe any such restriction so imposed by the Mayor or City Utility Superintendent, provided public announcement of such restriction has been made.
   (B)   Unless announced otherwise, recreational use of water, including watering lawns and gardens, shall be limited to the following:
      (1)   Water users having an even-numbered street address may water on Mondays, Wednesday, and Friday with the exception of no watering from 10:00 a.m. to 6:00 p.m.;
      (2)   Water users having an odd-numbered street address may water on Tuesdays, Thursdays, and Saturdays with the exception of no watering from 10:00 a.m. to 6:00 p.m.;
      (3)   Public entities such as: hospitals; schools; Rainbow Fountain Park; court house; and city properties will water on the assigned day of its street address exception of no watering from 10:00 a.m. to 6:00 p.m.; and
      (4)   No watering on Sundays.
   (C)   The municipality may turn off the water supply to the premises of any person who, after having been notified of the imposition of such emergency restrictions on the use of water, disregards such restrictions, and such supply of water shall not again be turned on until the cost for turning the water off and turning the water on has been paid to the municipality. During emergency water restriction periods, the charge for turning off and turning on the water service and water service termination periods shall be as follows:
      (1)   First offense: the turn off and turn on charge shall be $25 each;
      (2)   Second offense: occurring within six months of the first offense, the turn off and turn on charge shall be $50 each, and the water service will be terminated for 24 hours; and
      (3)   Third and subsequent offense occurring within six months of the first offense: the turn off and turn on charge shall be $100 each, and the water service will be terminated for 48 hours following each offense.
