4-1-12: RESPONSIBILITIES OF COMMERCIAL HAULERS AND/OR PRODUCERS OF COMMERCIAL SOLID WASTE:
Any person who engages in collection, hauling, or disposal of solid waste within Benewah County or who generates solid waste as result of business, commercial or industrial activities shall comply with the provisions of this chapter and any regulations adopted pursuant to authority established by this chapter.
All Commercial Solid Waste Generators with a physical location within the unincorporated area of the county shall be required to maintain a dumpster or similar receptacle for the collection of commercial solid waste and shall contract with a county approved Commercial Hauler/Commercial Collection Service for transfer of such waste to the county transfer station.
Any contractor operating a Solid Waste Collection Service for the county shall segregate collections from any non-county owed (i.e. private, municipal, tribal or commercial) collection site such that the non-county owned solid waste may be segregated from county owned, residential collection site solid waste collections.
Failure of solid waste collectors, haulers and/or Commercial Solid Waste Generators to comply with regulations implemented to carry out responsibilities established by this chapter may result in imposition of a surcharge on fees charged to the hauler for use of county operated disposal facilities. Such failure shall also be considered a violation of this chapter, subject to all penalties and remedies otherwise prescribed herein and in Idaho Code section 31-4410. (Ord. 2023-157, 10-23-2023)
4-1-13: IMPROPER DISPOSAL AT AN APPROVED DISPOSAL SITE:
Any person who deposits or disposes of any hazardous or otherwise dangerous waste matter at. or provides for delivery of same to an approved solid waste disposal site, shall be liable for the full costs of controlling and eliminating any posed health hazard and/or properly disposing of said dangerous materials, as may be incurred by Benewah County or any other public agency.
