11-1-3: GENERAL APPLICATION PROCESS:
   A.   Purpose And Application: The purpose of this section is to outline the general application process for a permit or decision under provisions of this chapter unless otherwise required by Idaho Code or the Benewah County subdivision ordinance.
   B.   Application Requirements:
      1.   Submittal: Requests for permits and decisions shall be submitted on approved forms to the administrator.
      2.   Required Information: At a minimum, the application shall require the following information:
         a.   Name, address and contact information of the applicant and the applicant's representative;
         b.   Proof of current ownership in the property which is subject of the application or signed letter of authorization from the property owner for making application;
         c.   Legal description of the property; and
         d.   Statement of project intent for making the application.
      3.   Additional Information: Requests for permits and decisions may require additional application information as determined by the administrator.
      4.   Electronic Submittal: The administrator may allow some information to be submitted in an electronic format.
      5.   Application Fee: An application fee shall be paid at the time of the submission of the application for approval, in accordance with any fee schedule adopted by resolution by the board of county commissioners.
      6.   Professional Fees: In addition to the payment of application fees, the applicant shall be required to reimburse the county for all professional engineering fees or legal fees incurred by the county. A schedule of fees shall be established by the board of county commissioners and filed in the county clerk's office and may be amended from time to time upon resolution duly enacted by the board.
      7.   Termination Of Process: If the applicant fails to pay the county fees on a timely basis, the county may suspend or if deemed appropriate, terminate the processing of the application. The applicant may be required to sign a reimbursement agreement.
      8.   Determination Of Completeness:
         a.   An application shall contain all information deemed necessary by the administrator to determine if the proposal will comply with the applicable requirements of this chapter.
         b.   Within thirty (30) days of receipt of an application, or such later time, but not to exceed sixty (60) days, the administrator shall certify the application as complete for review or require additional information be submitted.
         c.   After the application is certified as complete, the commissioners, commission, or administrator may require applicants to submit additional information and materials.
         d.   No further action shall be taken on the application until such additional information and materials have been submitted. If the additional information is not submitted within thirty (30) days from the administrator's request, or the date mutually agreed upon by the applicant and the administrator, the application will be returned to the applicant.
         e.   The administrator shall issue a notice of application acceptance and completion by letter to the applicant. The applicant will be informed regarding a public notice of a pending public hearing or other action being taken on the application.
         f.   The administrator shall begin processing the application once the application is deemed complete.
         g.   If at any time during the processing of the application, the administrator, the planning and zoning commission or the county commissioners request additional information, documents or prepayment of costs from the applicant and the requested materials are not submitted within sixty (60) days from the request, or the date mutually agreed upon by the applicant and the county, the county may suspend or if deemed appropriate, terminate the processing of the application.
