6-1-1: TITLE:

This chapter shall be known and may be cited as the BENEWAH COUNTY MOTOR VEHICLE ORDINANCE. (Ord. 53, 11-9-1987)

6-1-2: PURPOSE:

The purpose of this chapter is to adopt certain portions of the Idaho motor vehicle laws by reference pursuant to the provisions of Idaho Code section 49-208(4). (Ord. 53, 11-9-1987; amd. 2011 Code)

6-1-3: ADOPTION AND AVAILABILITY OF LAWS:

   A.   Adoption Of Laws By Reference: All portions of Idaho Code title 49, chapters 2, 3, 5, 6, 7, 8, 9, 10, 11, 15, 27 and 28 not otherwise preempted by the state are herein adopted by reference, and any violation thereof is a violation of this chapter.

   B.   Availability For Public Use And Examination: The county clerk, during normal business hours, shall make available not less than three (3) copies of the full provisions of Idaho Code title 49, chapters 2, 3, 5, 6, 7, 8, 9, 10, 11, 15, 27 and 28 for public use and examination. 6-1-4: PENALTIES:

Penalties for violation of this chapter shall be the same as those set out in Idaho Code title 49 for violation of specific code sections and shall conform with the state designation of either a misdemeanor or an infraction, as the case may be. (Ord. 53, 11-9-1987)
