5-3-12: PENALTIES:
   A.   For a first violation of this chapter, the violator may be fined up to five dollars ($5.00) per animal. For a second violation of this chapter, the violator may be fined up to twenty five dollars ($25.00) per animal, notwithstanding that the livestock involved may not be the same livestock as were involved in the previous violation. For a third violation of this chapter, the violator may be fined up to seventy five dollars ($75.00) per animal, notwithstanding that the livestock involved may not be the same livestock as were involved in the previous violations. For a fourth violation of this chapter, the violator may be fined up to one hundred dollars ($100.00) per animal, notwithstanding that the livestock involved may not be the same livestock as were involved in the previous violations. In no event shall the total fine imposed for each violation of this chapter exceed the sum of three hundred dollars ($300.00). (Ord. 14, 9-12-1977, eff. 9-15-1977)
   B.   A fifth or subsequent violation shall constitute a misdemeanor and, upon conviction thereof, shall subject the violator to penalty as provided in section 1-4-1 of this code, notwithstanding that the livestock involved may not be the same livestock involved in the previous violations.    C.   Each day upon which a violation of this chapter occurs shall constitute a separate violation. (Ord. 14, 9-12-1977, eff. 9-15-1977)
