(a) Council hereby declares that any video service provider receiving an authorization from the Ohio Department of Commerce to provide cable service within the City’s territorial boundaries pursuant to Ohio R.C. 1332.32(C), shall pay a franchise fee of five percent (5%) of gross revenues derived from the operator of the cable system to provide services to the City.
(b) Council hereby declares that any video service provider receiving an authorization from the Ohio Department of Commerce to provide cable service within the City’s territorial boundaries pursuant to Ohio R.C. 1332.32(B)(2)(g), shall be required to include advertising revenue in its gross revenue calculations in determining franchise fee revenue to the City.
