§ 150.09 MECHANICAL CODE.
   (A)   The Mechanical Code of the village (hereinafter referred to as the "Mechanical Code") shall hereafter be identical with the provisions of that publication entitled International Mechanical Code, 2018 edition, and which is incorporated herein by reference as if fully set forth, except as amended by this chapter.
   (B)   Amendments to Code. Additions, insertions, changes and deletions to sections of the International Mechanical Code are hereby revised as follows:
      (1)   Subsection [A] 101.1 Title (insert).
         Insert: The Village of Bellwood.
      (2)   Subsection [A] 103.1 Department of Mechanical Inspection - General (change).
         Change: The Building and Zoning Department shall be charged with the enforcement of the Mechanical Code, and the Building Commissioner shall be known as the Code Official.
      (3)   Subsection [A] I 06.4.3 Permit Expiration (delete subsection and insert).
         Delete: Entire subsection.
         Insert: Permit expiration shall be governed by the village code.
      (4)   Subsection [A] 106.4.4 Permit Extensions (delete subsection and insert).
         Delete: Entire subsection.
         Insert: Permit extensions shall be governed by title the village code.
      (5)   Subsection [A] 106.5.2, Fee Schedule (insert).
         Insert: The fee schedule shall be governed by the village code.
      (6)   Subsection [A] 106.5.3 Fee Refunds (delete entire subsection).
         Delete: Entire subsection.
      (7)   Subsection [A] 108.4 Violation Penalties (delete entire subsection).
         Delete: Entire subsection.
      (8)   Subsection [A] 108.5 Stop Work Orders, Fine Amounts (insert at each ($500.00)).
         Insert: “as provided in the village code for each day in violation.”
      (9)   Section 109 Means of Appeal (delete entire appeals section and insert).
         Delete: Entire section.
         Insert: See Village Ordinance, Chapter 32, Code Enforcement Board of Appeals. Section 32.007 Appeal Procedure.
      (10)   Subsection 301.10 Electrical (delete "NFPA 70" and insert).
         Delete: NFPA 70.
         Insert: NEC 2017.
      (11)   Subsection 301.11 Plumbing Connections (delete "International Plumbing Code" and insert).
         Delete: International plumbing code.
Insert: State Plumbing Code.
      (12)   Subsection 506.1 Commercial Kitchen Hood Ventilation System Ducts and Exhaust Equipment (add).
         Add: ... shall comply with the requirements of this section (add) except current National Fire Protection Association (NFPA) 96 and UL300 for ventilation control and fire protection or commercial cooking operations regulations shall be applicable where this standard is more stringent than this code tor all installations.
      (13)   Subsection 506.3.2.1 Duct joint types (delete "butt joints").
         Delete: "butt joints".
      (14)   Subsection 507.1 Commercial Kitchen Hoods (add).
         Add: ... shall comply with the requirements of this section (add) except current National Fire Protection Association (NFPA) 96 and UL300 for ventilation control and fire protection of commercial cooking operations regulations shall be applicable where this standard is more stringent than this code for all installations.
      (15)   Subsection 508.1 Commercial Kitchen Makeup Air (add).
         Add: The National Fire Protection Association (NFPA) 96 and UL300 for ventilation control and fire protection of commercial cooking operations regulations shall be applicable where this standard is more stringent than this code for all installations.
   (C)   Compliance required; application of provisions.
      (1)   Compliance required. It shall be unlawful to design, install, construct, reconstruct, alter or use/maintain mechanical systems in any building or structure in the village in violation of the terms and provisions of this chapter.
      (2)   Application to existing permits. This chapter shall not be construed to extend to or affect any construction activity for which a permit was issued or application for permit filed prior to the effective date hereof, except for fees not yet due or payable, unless the Building Commissioner determines that any provision of this chapter or the regulations incorporated herein by reference should be applied for reasons of public health and safety.
   (D)   Penalties. Any person, firm or corporation violating the terms and provisions of this chapter shall be liable for a penalty in the amount of 100% of any unpaid fee and, in addition, shall be punishable as provided in this code for each violation.
