§ 151.04 REFUSE CONTAINER ENCLOSURES.
   All garbage cans, refuse containers, recycling containers, grease containers and dumpsters and roll- off boxes in industrial, business or commercial, and multi-family residential (three units or more) zoning districts shall be located and stored within a designated refuse enclosure sufficient to screen the same from view from any public rights-of-way (but not including alleys). The container lids shall be kept closed at all times. The enclosure shall be used strictly for the confinement of refuse, recyclable material, grease containers, and compacting equipment and shall not be used for the outside storage of any other materials or equipment. The gate shall be kept closed, except when the contents of the enclosure are removed and replaced. Maintenance of the enclosure shall be the responsibility of the owner of the property. This section shall not apply to temporary construction, roll- off containers used exclusively during construction or remodeling or to residential units service by curbside garbage collection.
   (A)   All enclosures shall screen from view all refuse disposal areas on all sides with an opaque non- combustible fence structure, such as chain link fencing with slats or other fencing material approved by the Building Commissioner or his or her designee.
   (B)   On the fourth side, a gate shall be constructed such that all containers may easily be removed and replaced when emptied. The gate shall be secured with a post that inserts into a pipe embedded into the pavement to ensure the gate’s stability and proper placement when closing.
   (C)   The enclosure walls shall not exceed seven feet and shall be not less than six feet in height. The minimum size or minimum number of refuse enclosures shall be sufficient to hold all refuse containers used on the property.
   (D)   The minimum access required shall be the amount of pavement area needed for standard size disposal truck to gain access to and from the disposal area.
   (E)   Any enclosure lawfully existing or under construction on the date of passage of this section which does not conform to the provisions of this section shall be removed or made to conform on or before January 1, 2010.
   (F)   Any existing enclosure that becomes damaged to an extent that it not longer serves its purpose, as determined by the Building Commissioner, must be replaced in conformance with this section.
