The appropriate sections in Chapter 156 are hereby amended to reflect the following: home day care facility shall be permitted as conditional use in all residentially zoned districts subject to demonstrating the following:
(A) Satisfaction of all State of Illinois Department of Children & Family Service licensing requirements;
(B) Compliance with all applicable building, fire safety, health codes, and business registration requirements;
(C) Conformance with all applicable lot size, building size, setback and lot coverage requirements, except if the structure is a legal non-conforming structure;
(D) Filing of a home day care registration form with the Village Comptroller' office;
(E) Making no structural or decorative alterations that would (i) alter the residential character of an existing or proposed residential structure or (ii) be incompatible with surrounding residences;
(F) Providing a safe passenger loading area;
(H) Landscaping the site in a manner compatible with adjacent residences;
(I) Providing a fence of at least four feet in height around the required yard;
(J) Demonstrating that the proposed site is not located within 1,000 feet of another home day care and child care facility as measured nearest lot line to nearest lot line or that no more than two other home day care and child care facilities currently exist on the same block of the proposed site, block shall mean and be measured as "city block" rather than street designation;
(K) Demonstrating compliance with any other reasonable regulation imposed by the zoning official or the Planning Commission
