§ 138.15 DEFINITIONS.
   (A)   Subject to division (B) below, for the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CANNABIS. This term shall have the meaning ascribed to it in ILCS Ch. 720, Act 550, § 3 as if that definition were incorporated herein.
   CONTROLLED SUBSTANCE. This term shall have the meaning ascribed to it in ILCS Ch. 720, Act 570, § 102 as if that definition were incorporated herein.
   DELIVER or DELIVERY. The actual, constructive or attempted transfer of possession, with or without consideration, whether or not there is an agency relationship.
   DRUG PARAPHERNALIA. All equipment, products and materials of any kind which are peculiar to and marketed for use in planting, propagating, cultivating, growing, harvesting, manufacturing, compounding, converting, producing, processing, preparing, testing, analyzing, packaging, repackaging, storing, containing, concealing, injecting, ingesting, inhaling or otherwise introducing into the human body cannabis or a controlled substance in violation of the laws of the State of Illinois or the village code. It includes, but is not limited to:
         (a)   Kits peculiar to and marketed for use in manufacturing, compounding, converting, producing, processing or preparing cannabis or a controlled substance;
         (b)   Isomerization devices peculiar to and marketed for use in increasing the potency of any species of plant which is cannabis or a controlled substance;
         (c)   Testing equipment peculiar to and marketed for private home use in identifying or in analyzing the strength, effectiveness or purity of cannabis or controlled substances;
         (d)   Diluents and adulterants peculiar to and marketed for cutting cannabis or a controlled substance by private persons;
         (e)   Objects peculiar to and marketed for use in ingesting, inhaling or otherwise introducing cannabis, cocaine, hashish or hashish oil into the human body, including, where applicable, the following items:
            1.   Water pipes;
            2.   Carburetion tubes and devices;
            3.   Smoking and carburetion masks;
            4.   Miniature cocaine spoons and cocaine vials;
            5.   Carburetor pipes;
            6.   Electric pipes;
            7.   Air-driven pipes;
            8.   Chillums;
            9.   Bongs;
            10.   Ice pipes or chillers; or
            11.   Glass cocaine or crack pipes;
         (f)   Any item whose purpose, as announced or described by the seller, is for use in violation of this subchapter.
   (B)   Whenever reference is made in this chapter to the ILLINOIS CANNABIS ACT or the CANNABIS ACT it shall mean the Cannabis Regulations and Tax Act of Illinois approved June 25, 2019, in force January 1 2020 All other words and phrases used herein shall have the same meaning as the same or similar words or phrases defined by and used in said CANNABIS REGULATIONS AND TAX ACT including the following:
      ACT. The Cannabis Regulation and Tax Act of Illinois approved 6-25-19 as Public Act 101-0027.
      ADVERTISE. To engage in promotional activities including but not limited to: newspaper, radio, internet and electronic media, and television advertising. the distribution of fliers and circulars, and the display of window and interior signs.
      CANNABIS. Marijuana, hashish, and other substances that are identified as including any parts of the plan Cannabis sativa and including derivatives or subspecies such as indica, of all strains of cannabis, whether growing or not: the seeds thereof the resin extracted from any part of the plant, and any compound, manufacture, salt, derivative, mixture, or preparation of the plant its seeds or resin including tetrahydrocannabinol (THC) and all other naturally produced cannabinol derivatives whether produced directly or indirectly by extraction; however CANNABIS does not include the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant any other compound manufacture salt derivative, mixture, or preparation of the mature stalks (except the resin extracted from it) fiber oil or cake or the sterilized seed of the plant this incapable of germination. CANNABIS does not include industrial hemp as defined and authorized under the Industrial Hemp Act. CANNABIS also means concentrate and cannabis-infused products.
      CANNABIS BUSINESS ESTABLISHMENT. A cultivation center, craft grower, processing organization dispensing organization or transporting organization.
      CANNABIS CONTAINER. A sealed, traceable container, or package used for the purpose of containment of cannabis or cannabis-infused product during transportation.
      DISPENSARY. A facility operated by a dispensing organization at which activities licensed by the Act may occur.
      DISPENSING ORGANIZATION. A facility operated by an organization or business that is licensed by the Department of Financial and Professional Regulation to acquire cannabis from a cultivation center craft grower processing organization or another dispensary for the purpose of selling or dispensing cannabis, cannabis-infused products, cannabis seeds paraphernalia or related supplies under this Act to purchasers or to qualified registered medical cannabis patients and caregivers.
      OWNERSHIP AND CONTROL. Ownership of at least 51% of the business including corporate stock if a corporation, and control over the management and day-to-day operations of the business and an interest in the capital assets, and profits and losses of the business proportionate to percentage of ownership.
      PERSON. A natural individual firm, partnership, association, joint stock company, joint venture, public or private corporation, limited liability company, or a receiver, executor, trustee, guardian or other representative appointed by order of any court.
