§ 117.174 WEIGHMASTER.
   (A)   Appointment. Any person owning a scale suitable for weighing any commodity, produce or articles of merchandise in load lots, when contained in any wagon, auto truck or other vehicle, or in any quantity when not contained in any wagon, auto truck or load, lots shall be eligible for appointment as a public weighmaster in the village after complying with the provisions of this subchapter.
   (B)   Application; bond; license.
      (1)   Every applicant for a license as a public weighmaster, shall file an application in writing conforming to the requirements of Chapter 110, General Business Licensing, and set forth the location of the place of business for which such license is requested. Such application shall also contain the following agreement:
“The applicant hereby agrees and consents as a condition of the issuance of the license hereunder, that in case the applicant as a public weighmaster weighs any load lot of any commodity, procures an article of merchandise sold in load lots, by weight, sold or delivered by the applicant or by any person directly or indirectly interested with the applicant in the operation of the public scale of the applicant, the Chief of Police, or the purchaser or consignee shall have the right to reweigh any such article of merchandise, produce or other load as provided in this subchapter. This condition is accepted by the applicant with the understanding that same shall, upon the issuance of a license hereunder at once become binding upon him.”
      (2)   Such applicant shall also execute a bond and present it with his or her application to the village in the sum of $2,000, with such sureties as may be approved by the President and the Board of Trustees, conditioned upon the duties of public weighmaster, and for the payment of any fines which may be imposed upon him or her for violation of any such duties. Upon compliance with these conditions and upon payment of the sum of $10 as an annual license fee, he or she may be issued a license authorizing him or her to act as a public weighmaster.
      (3)   The license so issued shall contain apt words indicating that the license is issued subject to the conditions and agreements herein set forth, and any person violating any of these conditions shall be liable to a penalty of $50, in addition to any other penalty prescribed by law.
   (C)   Deputy weighmaster. Each public weighmaster shall have the power to appoint all necessary deputies to attend such weights and scales, such deputies to furnish a bond in the same amount as the public weighmaster and conditioned in the same manner. Each deputy weighmaster must pay an annual fee of $5. Each public weighmaster shall be answerable for all acts of the deputy weighmaster but the weighmaster's responsibility shall not relieve the deputy's liability for his or her own acts. The weighmaster may cancel such appointment at any time but he or she must notify the Village Clerk of such cancellation.
