§ 52.53 LIABILITY.
   (A)   Service failures. All waterworks service supplied by the waterworks system shall be upon the express condition that the village shall not be liable nor shall any claim be made against it for damages or injury caused by reason of the breaking of any main, branches, service pipes, apparatus or appurtenances connected with said system or any part or portion thereof, or for any interruption of the supply by reason of the breakage of machinery, or by reason of stoppage, alterations, extensions or renewals.
   (B)   Service interruption. The village reserves the right to shut off water at any time in the mains for the purpose of repairing, cleaning, making connections with or extensions to same, or for the concentrating of water in any part of the village in case of fire, and for restricting the use of water in case of deficiency in supply, including the suspension of the use of water for sprinkling lawns or gardens. No claim shall be made against the village by reason of the breaking of any service pipe or service cock, or damage arising from shutting off of water for repairing, laying or relaying mains, hydrants or other connections, or repairing any part of the water system, or from failure of the water supply, or by increasing the water pressure at any time, or from concentrated or restricted use of water as above.
   (C)   Adjustment of bills for meter error.
      (1)   Fast meters. When, upon test, a meter is found to be registering fast within the tolerances above set forth in § 52.52(C), the village shall refund to the customer the amount of the overcharge, based upon corrected meter readings for the period the meter was in use, but not to exceed a period of six months.
      (2)   Slow meters. When, upon test, a meter is found to be registering slow beyond the tolerances above set forth in § 52.52(C), the village shall bill the customer for the amount of the undercharge, based upon corrected meter readings for the period the meter was in service, but not to exceed a period of six months.
      (3)   Failed meter reads. In the event a water meter fails to register during any month, charge will be made based upon an estimate considered appropriate by the village. In the event there was no meter at this place during the previous year, a charge will be made upon an estimate fixed by the village, which shall be paid by the customer.
      (4)   General. When it is found that the error in a meter is due to some cause, the date of which can be fixed, the overcharge or the undercharge shall be computed back to, but not beyond, such date.
