§ 50.36 ON-SITE MULTI-FAMILY STRUCTURE RECYCLING PROGRAM.
   (A)   Program requirements.
      (1)   All owners of multi-family properties, as defined above, shall be required to institute an on- site recycling program, with collection of recyclable materials to be no less than one pickup per week.
      (2)   Said program shall be instituted on or before July 1, 2005.
      (3)   Multi-family property owners are required to use the village's franchised recyclables collection hauler. Multi-family property owners shall be billed for such services by the franchised hauler or directly by the village as determined by the Comptroller. The fee for such service shall be as established by the village and the franchised hauler. In the event the franchised hauler is unable to perform, owners shall be subject to the same regulation herein listed, except that the private scavenger shall bill the owner directly for his or her services.
      (4)   An acceptable recycling program shall include, but is not limited to, the following components:
         (a)   Siting and design of common area collection areas for recyclable materials:
         (b)   Recyclable materials collection;
         (c)   Provision of common area recycling containers;
         (d)   Data collection and reporting;
         (e)   Educational campaign and materials; and
         (f)   Recycling program administration and maintenance.
   (B)   Specific requirements.
      (1)   Recycling collection areas for residents shall be conveniently located and maintained within common areas in or near the buildings and consist of separate containers for the purposes of temporary storage of recyclables. Whenever possible, recycling containers should be placed adjacent to common area solid waste collection containers.
      (2)   Indoor common area collection/storage areas shall be established in accordance with appropriate village fire safety and property maintenance codes.
      (3)   Exterior recyclables storage areas shall be established in accordance with village requirements for solid waste enclosures.
      (4)   The multi-family property owner shall maintain all recycling areas, including the containers, in a clean, sanitary and litter-free manner.
      (5)   On-Site Multi-Family Structure Recycling Program are required to offer collection of a minimum of five of the following types of recyclable material:
         (a)   Corrugated cardboard.
         (b)   Newspaper.
         (c)   Telephone books.
         (d)   Chipboard.
         (e)   Magazines and catalogs.
         (f)   "Junk mail."
         (g)   High grade paper.
         (h)   Glass bottles (three colors).
         (i)   Aluminum, steel, tin and bi-metal cans.
         (j)   PETE (#1) and HDPE (#2) plastic bottles
         (k)   Miscellaneous ferrous and non-ferrous scrap metals.
      (6)   Recyclable materials shall be source separated from other solid waste prior to collection for the purpose of recycling such materials. Separate collection containers and collection vehicles shall be employed.
      (7)   (a)   The minimum gallon amount of recycling container capacity (total weekly base recycling container capacity) an owner shall provide weekly for each structure shall be based upon the following formula:
 
7 gallons x number studio and 1 bedroom units +
8 gallons x number of 2-bedroom units +
9 gallons x number of 3-bedroom or more units
= total base weekly recycling container capacity
 
         (b)   The weekly base recycling container capacity may be met by a combination of container sizes and number of pick-ups, such as containers totaling half the base capacity picked up twice a week. Capacity per structure may be shifted within the multi-family property if necessary, so long as the total required capacity is met.
      (8)   The franchised scavenger providing the on-site recycling collection service shall be responsible for furnishing and replacing all common area recycling containers and collection vehicles which are deemed necessary in the recycling program.
      (9)   Multi-family property owners shall notify residents of the availability of recycling services through a formal and on-going educational campaign and shall use their best efforts to gain and maintain participation in the program.
      (10)   It shall be unlawful for any unauthorized persons to remove or damage any recyclable materials placed in designated containers or the containers themselves. Title to recyclable material shall pass to the scavenger when the materials are placed into the collection vehicle.
      (11)   A sale certificate, as required by the village code, shall not be approved until such time as compliance with this subchapter is verified by the Village Inspector.
   (C)   Fee requirements.
      (1)   A recycling fee for the maintenance and operation of the on-site recycling collection program shall be imposed upon each multi-family structure in the amount of $5 per apartment unit, per month. It shall be the duty of the recycle hauler that is in contract with the village to secure the payment of the fee from the residential customer and to pay over to the Village Treasurer the fees collected.
      (2)   A $75 refundable deposit shall be required on all recycling containers used for the program that are provided by the village or refuse hauler. It shall be the duty of the refuse hauler to secure the payment of the fee from the residential customer and to pay over to the Village Treasurer the fees collected.
      (3)    If a check made payable to the village or hauler is returned for any reason, a $100 fee will be assessed in addition to costs of collection and attorney fees. The village shall also have the right to pursue any offender and all rights under ILCS Ch. 720, Act 5, § 17-1a of the Illinois Criminal Code.
