§ 36.11 FAIR LABOR STANDARDS ACT.
   (A)   All elected officials, personal staff members and officials in policy making positions who are selected or appointed by the elected public officials and certain advisers to such officials, are excluded from the coverage of the Fair Labor Standards Act (FLSA), Title VII, and other similar laws. All persons described in this section are hereinafter referred to as excluded personnel. All excluded personnel are exempt from any and all civil service laws and/or civil service protection. The term excluded personnel includes, but is not limited to the following:
      (1)   The Mayor (Village President);
      (2)   The Clerk;
      (3)   The Collector;
      (4)   Village Trustees;
      (5)   The Comptroller;
      (6)   Director of Public Safety;
      (7)   Police Chief;
      (8)   Deputy Police Chief;
      (9)   Fire Chief;
      (10)   Superintendent of Public Works;
      (11)   Supervisor of the Water Department;
      (12)   Director of Community Services;
      (13)   Zoning Administrator;
      (14)   Building Commissioner;
      (15)   Community Development Director;
       (16)   Human Resources Director;
      (17)   Executive Secretary to the Mayor;
      (18)   Executive Secretary to the Village Clerk;
      (19)   Police and Fire Commission Member;
      (20)   Zoning/Planning Board Member; or
      (21)   Youth Program Supervisor.
   (B)   Excluded personnel are subject to the terms and conditions of employment set forth in their individual contracts, or those terms and conditions established by resolution or ordinance.
   (C)   The terms and conditions of employment set forth in the individual contracts of excluded personnel or established by resolution or ordinance may vary from the terms and conditions set forth in the village Personnel Manual.
   (D)   Certain employees are exempt from the overtime and minimum wage provisions of the Fair Labor Standards Act and its federal regulations. All persons described in this section are hereinafter referred to as exempt personnel. The term exempt personnel includes, but is not limited to the following:
      (1)   Treasurer;
      (2)   Deputy Police Chief;
      (3)   Fire Captains;
      (4)   Accountant;
      (5)    Director of Bellwood Office of Emergency Management (Chief of B.O.E.M);
      (6)   Administrative Secretary to the Fire Chief;
      (7)   Administrative Secretary to the Police Chief;
      (8)   Administrative Secretary to the Superintendent of Public Works; or
      (9)   Administrative Assistant to the Comptroller.
