§ 36.04 PAYMENT FOR SERVICES RENDERED IN PROVIDING AID OR EMERGENCY RELIEF.
   (A)   For the purpose of this section the following definition shall apply unless the context clearly indicates or requires a different meaning.
      THIRD PARTY. Any person, company or business entity, but not if such person is an employee or an officer of the village, a person directly or indirectly sharing an interest in such services with an employee or officer of the village, nor a company any portion of which is owned by an employee or officer of the village.
   (B)   (1)   The recipients or benefactors, or the administrators, personal representatives, executors, successors, heirs or assigns thereof, as determined by the head of the village's department rendering aid or emergency relief, shall be, and are, obligated to reimburse the village in the actual amount of payment made by the village to third parties for rendered in providing village services and/or benefits, aid or emergency relief and for payments to replenish necessary supplies and equipment used while providing aid or emergency services.
      (2)   The head of each of the village's departments incurring third party costs shall notify the Village Comptroller's office of the circumstances and provide a copy of the invoice or billing statement from the third party that specifies the nature of the expenditure and the amount to be, or in fact, paid. The Comptroller shall cause an invoice to be issued for the amount certified by the department head as to each circumstance reported.
   (C)   The Village Comptroller shall allow for a reasonable time of payment of the reimbursement amount and shall hear any complaints or objections on the type and amount of expense. The Village Comptroller may adjust the amounts invoiced based upon demonstrated hardship but is not required to adjust. In the event that no payment or response to request for reimbursement has been received within 30 days from the date of invoice, the Village Comptroller is authorized to undertake action as provided by law for the recovery of money due to the village.
