§ 33.25 CHARGES FOR AMBULANCE SERVICES FOR NONRESIDENTS.
   (A)   The President and Board of Trustees finds that the continuing increase in the costs of providing adequate fire protection and other public safety services has created a need for additional funds to provide these services. This section is authorized, and it is further declared that the fees are levied solely for the purpose of providing revenue to help defray the costs of the services covered by the fees.
   (B)   (1)   The village shall collect a fee for emergency ambulance transportation provided by the village. Such fee shall be as follows:

      (2)   Further, a fee of $500 shall be collected for the response of a fire truck company to the scene of a vehicle accident. Additional fees shall be collected, when applicable, according to the following schedule:

      (3)   The above fees shall be binding upon all persons receiving such services as well as their successors in interest, assigns, estates and heirs.
   (C)   All monies received under the provisions of this section shall be deposited with the Comptroller's office and shall be used for funding expenses necessary to furnish fire protection, emergency medical services and other public safety services by the village.
   (D)   The ambulance transport fee may change annually, effective January 1 of each year without further Village Board action, pursuant to the annual report submitted for the previous year to the Illinois Department of Healthcare and Family Services (HFS) and/or the federal Centers for Medicare and Medicaid Services (CMS) as part of the Ground Emergency Transport Program (GEMT) reflecting the actual cost incurred for transport of residents and nonresidents. In the event the annual calculated fee for the upcoming year is less than the current fee being assessed, the current fee shall be assessed for the following calendar year.
