§ 31.43 VILLAGE MARSHAL AND DEPUTY MARSHALS.
   (A)   Village Marshals.
      (1)   Offices of Village Marshals established; appointments. There is hereby established the offices of Village Marshals who shall be appointed by the President with the advice and consent of the Board of Trustees in such number as shall be determined from to time by the corporate authorities.
      (2)   Term of office; removal; compensation.
         (a)   The Village Marshals shall each serve at the discretion of the President and Board of Trustees and may be removed from office at the will of the President and Board of Trustees.
         (b)   Each Village Marshal shall receive such hourly compensation for services as determined by the corporate authorities. Village Marshals shall maintain their permanent residences in the village.
      (3)   Duties and responsibilities. The Village Marshals shall not be considered to be members of the regular police force. Their duties and responsibilities shall be as fully set forth by the Chief of Police regarding the enforcement of all village ordinances and codes pertaining to local building, health, licensing, animal, non-moving vehicles and any other ordinances or codes specifically assigned to the Village Marshals in the area of public safety. The Village Marshals shall also be known as the Public Safety Specialists or Inspectors.
      (4)   Carrying firearms. The Village Marshals are authorized to carry firearms while on duty subject to such licensing and training as determined by the statutes of the state of Illinois and the directives of the Chief of Police.
   (B)   Deputy Marshals.
      (1)   Office of Deputy Marshal established; appointment. There is hereby established the office of Deputy Marshal. Deputy Marshals shall be appointed by the President with the advice and consent of the Board of Trustees in such number as the corporate authorities shall from time to time deem necessary. Deputy Marshals shall maintain their permanent residence in the village.
      (2)   Terms of office; removal from office; compensation.
         (a)   The Deputy Marshals shall serve at the discretion of the President and Board of Trustees and may be removed from office at the will of the President and Board of Trustees.
         (b)   The Deputy Marshals shall receive such hourly compensation for their services as determined by the corporate authorities. In the event the Deputy Marshals elect union representation, the collective bargaining agreement shall be consulted.
      (3)   Supervision by Chief of Police. The Deputy Marshals shall not be considered members of the Police Department and shall not function on a full- time basis. Identification symbols of the Deputy Marshals shall be different and distinct from those used by the members of Police Department. The Deputy Marshals shall at all times during the performance of their duties be subject to the direction and control of the Chief of Police in support of Police Community Relations and other civilian level support services.
      (4)   Duties and responsibilities. Deputy Marshals shall perform such duties as determined by the Chief of Police.
      (5)   Carrying firearms. Deputy Marshals shall not carry firearms except with the special permission of and when issued by the Chief of Police, and when in uniform and while in the performance of their duties. The carrying of firearms by Deputy Marshals shall be subject to such licensing and training as determined by the statutes of the state of Illinois and by the directives of the Chief of Police.
