§ 92.16 OPEN BURNING PERMIT.
   (A)   On application to the Village Fire Chief for an open burning permit by a contractor for the construction of a building(s), a permit may be issued to burn natural wood, herbaceous material, lumber, paper, cardboard, and wooden boxes at the construction site. The permit shall be for 90 days and can be renewed.
   (B)   The permit may be suspended by the Fire Chief if an investigation produces evidence of any of the following:
      (1)   Products having a rubber or petroleum base have been burned; or
      (2)   Burning has not been supervised at all times by an employee.
   (C)   Within 28 days, but no sooner than seven days after the suspension of the permit, the Village Fire Chief shall hold a hearing to determine whether this section has been violated. If violations are found to have occurred, the Village Fire Chief may revoke the permit.
   (D)   The Village Fire Chief shall give prior written notice of the hearing to the permit holder. The hearing shall not be held until after five days from mailing of the notice by certified mail.
