§ 90.31 RESPONSIBILITY FOR EXCAVATION.
   The full primary responsibility of any street boring excavation, trench, or other opening shall be that of the permit applicant, who shall at all times keep the same properly guarded and enclosed so that the safety of person, utilities, and vehicles using the street, alley, or right-of-way will be assured. This responsibility shall continue until permanent replacement of the pavement or the right-of-way surface to its original status is made and the removal of all equipment and obstructions in the right-of-way and shall include the defense, settlement, and payment of any and all claims, actions, and court judgments for damages or injuries to anyone arising in any way out of the creation or maintenance of the boring, excavation, or other opening by the permit holder. The permanent replacement of the pavement or right-of-way to its original status shall be inspected by the Village Administrator or his designee and shall be subject to his written approval before the permit applicant is released from his responsibilities under this subchapter.
