§ 92.17 RECREATIONAL FIRE PITS.
   The following restrictions are in addition to all restrictions imposed by other levels of government and create no additional rights:
   (A)   Location, type.
      (1)   No recreational fire shall be within ten feet from any structure, including but not limited to single-family houses, sheds, garages, fences, and any other building or structure. No recreational fire shall be within 25 feet from multiple residence buildings such as apartment buildings or houses divided as duplexes or multiple unit homes.
      (2)   No recreational fire may lack a reliable water source capable of being directly applied to the fire, or a commercially purchased fire extinguisher must be available nearby.
      (3)   Recreational fires must be contained within a structure or device designed to contain the fire and may be of a design purchased for residential use. No recreational fire may be capable of being larger than three feet in diameter, nor more than two feet high.
   (B)   Materials prohibited to be burned.
      (1)   No materials may be burned within the village that are not clean, seasoned firewood or commercially purchased fireplace starter logs or the equivalent.
      (2)   Examples of materials prohibited from being burned include but are not limited to yard waste, tree trimmings, grass clippings, leaves, paper, cardboard, garbage, food waste, food containers, rubber, grease, asphalt, petroleum, plastics, plastic-coated wire, or dead animals.
   (C)   Other requirements.
      (1)   Fires must be attended at all times and must be completely extinguished, and the ashes soaked with water, before being left unattended.
      (2)   Upon the complaint of any occupant of an adjoining or nearby property of disturbance due to smoke or embers disturbing their quiet enjoyment of their property, the fire must be immediately extinguished.
      (3)   If smoke obscures visibility of a roadway, the fire must be immediately extinguished.
      (4)   If a fire appears out of control, the Fire Department should be called to ensure the fire is contained; nothing in this section prevents the Fire Department from taking any action they deem appropriate, including extinguishing fires.
      (5)   All restrictions of fire imposed by any other government agency apply. Nothing in this section creates an exception to other restrictions and no rights are created by the restrictions of this section.
