A request for waiver shall be made in writing to the city council by delivery to the office of the city clerk setting out with specificity: the basis for the request; as required by section 28-33, a showing that the requested waiver does not constitute a threat to public health, safety or welfare; the precise provisions of the applicable plans and specifications from which a waiver is requested; and the specific alternatives to the plans and specifications proposed by the person requesting the waiver to the city council. The request for waiver shall be made prior to filing an application for a permit under this article and prior to a sale of the affected land, lot or parcel for which a waiver from the requirements of this article is requested. There shall be a filing fee of $30.00 for the request for waiver made in accordance with this article. Following the receipt of any such request the city council shall schedule and conduct a hearing at a regularly scheduled city council meeting. Following the hearing the city council shall grant or deny the application and, if denied, shall state the reason thereof.
