§ 11-102 SEIZURE OF UNTAXED MACHINES.
   (A)   In addition to such other penalties as may be provided by law, if at any time any machine or device is in use or operation without a proper sticker as provided by this article, said machine or device shall be sealed in a manner sufficient to temporarily prevent operation of the machine or device. No seal shall be broken except pursuant to the authority of the Permits and Inspections Department. A fee of $30.00 shall be imposed upon removal of any seal to cover the costs of sealing and its removal. No machine or device which has been sealed shall be relocated or otherwise removed from its location by any person.
   (B)   In the event any machine or device has been sealed pursuant to this section, the Permits and Inspections Department shall notify the operator and that person identified pursuant to section 11-96, if known to the city, that the machine has been sealed. Notice shall indicate that unless the applicable occupation tax has been paid and the sticker affixed within seven days after receipt of notice, the machine or device shall be subject to seizure and subsequent public sale.
   (C)   Unless the applicable occupation tax has been paid and the sticker affixed within seven days after receipt of notice, the machine or device shall be seized, taken into custody, and removed by the Bellevue Police Department upon the direction of the Permits and Inspections Department to be disposed of at public auction. No such property shall be offered for sale, or sold, unless and until it shall have remained unclaimed and uncalled for by the owner or their agent for a period of six months after the date of seizure. Provided, further, that the owner, or his agent, of any machine or device which has been seized may redeem such machine by paying the occupation tax due thereon, and an additional fee of $100.00 to cover the costs of removal and storage of said machine or device, plus the appropriate interest and penalties, shall be levied for each machine or device. The chief of the Bellevue Police Department shall designate a place to which such property shall be removed and stored. Upon proof of payment of all appropriate taxes, fees and levies and full compliance with the provisions of this article, such machines or devices shall be returned to the owner or his agent.
