Benches authorized by the provisions of this article shall be located and placed only as provided herein:
(A) No bus bench may be placed at any location other than a posted bus stop at which a bus regularly stops.
(B) Benches shall be, at a minimum, a distance of two feet from the curb and shall be placed so as to not obstruct pedestrian traffic flow or the cleaning of snow, ice or debris from sidewalks.
(C) Benches shall be placed in locations where the distance from the face of the curb to the property line is eight feet or more.
(D) No bench shall be positioned in such a manner as to block access to private property, or create sight or traffic hazards for motorists.
(E) No more than one bench shall be placed at any bus stop.
(F) All benches shall be inspected by the permittee periodically and shall be maintained by the permittee in a clean, safe and sightly condition.
(G) All benches in existence prior to January 1, 2008, and not in compliance with the provisions of this article shall be removed at the permittee’s expense no later than December 31, 2008; provided however, that in the event there is a contract for advertising on any such benches that the permittee entered into prior to January 1, 2008, said benches may remain until such contracts expire or until November 30, 2009, whichever occurs first. To qualify for such extended period beyond December 31, 2008, a verified statement must be made by the permittee for each bench including therein that such contract was made and entered into prior to December 31, 2007, and a copy of the contract shall be attached to the statement.
