§ 52.05 GARBAGE COLLECTION CONTAINERS.
   (A)   Each owner and/or tenant of private property shall comply with the minimum requirements contained in this section in the disposal of garbage.
   (B)   Each residential, industrial, institutional and/or commercial establishment, or person having refuse shall provide or be provided, approved refuse containers and shall place and keep all refuse therein. It shall be the responsibility of the property owner to provide containers to their tenants.
   (C)   Containers shall be supplied at all multifamily housing units by every property owner. A minimum of one (1) garbage can should be provided for every two (2) persons in each household in each multifamily structure.
   (D)   Owners and/or their tenants shall encapsulate and securely wrap in plastic any upholstered furniture, mattresses, pillows, cushions, box springs and similar items places out for collection or otherwise placed in the public right-of-way.
   (E)   Containers shall not be placed on the street right-of-way prior to 5:00 p.m., local time, on the day before scheduled collections, and shall be removed to the rear of premises before 11:00 p.m., local time, the day of scheduled collections.
   (F)   At times of collection by the city, all garbage cans and trash containers shall be placed at the curbside or alley designated by the city. No garbage can shall be kept upon any city or public property or neighboring property not in the ownership or tenancy of the person by whom the garbage is accumulated, whether such neighboring property shall be vacant or improved. Refuse containers shall, for the purpose of collection, be placed at ground level, and be made readily accessible to the collector.
   (G)   Notwithstanding provisions of the above, householders, commercial establishment, or other persons, may, by contract with collectors and approval of the city, be permitted to place containers at agreed places upon their premises.
   (H)   All garbage cans and trash containers shall be maintained in good condition and repair. All receptacles shall be provided with a cover sufficiently tight to prevent flies and/or other insects from having access to the contents of the receptacles. Storage of garbage or trash in an open garbage can or trash container shall not be permitted. Containers shall be water tight. All garbage cans and trash containers shall be subject to inspection and approval by the city.
   (I)   Users of the city waste collection service may rent or purchase a container commonly referred to as a toter. A toter is a container with a ninety-gallon capacity and is designed to be mechanically lifted for waste removal. With the exception of weight, a toter must meet all requirements for a container as described in § 52.03(A).
   (J)   When filled for collection, containers may not exceed a weight limitation of seventy-five (75) pounds unless stipulated herein.
   (K)   A non-containerized amount of trash or garden trash not exceeding the volume and weight limits of a garbage can, seventy-five (75) pounds may used. Non-containerized waste shall be suitably bound, lengths not to exceed 4 feet and/or boxed or packaged in water proof containers to permit handling for collection without coming apart.
   (L)   A property owner and/or occupant may arrange for the private removal and transportation of the trash and garden trash to points approved and designated by the city.
   (M)   The city's waste hauler may begin no sooner than 6:30 a.m. and must be completed by 4:00 p.m. of the same day.
   (N)   All vehicles used for collection of garbage shall be equipped with compacting devices or equivalent types of closed bodies and shall have enclosed cargo space.
