§ 52.01 DEFINITIONS.
   For the purposes of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   "CONTAINER." A receptacle made of a durable water tight, rust proof material, having a close fitting lid and (2) two handles to facilitate easy collection, that is no larger than 30 gallons and used for acceptance of garbage, refuse and yard waste.
   "DISPOSAL." The storage, collection, disposal, or handling of refuse.
   "DUMPSTER." Large containers to be handled by special equipment and are to be used by large volume users. Said containers must have tight fitting, locking lids, may not be in the public right-of-way and must be screened.
   "EXTERIOR PROPERTY AREAS." The open space on the premises and on adjoining property under the control of owners or operators of such premises.
   "GARBAGE." The animal and vegetable waste resulting from the handling, preparation, cooking and consumption of food.
   "HANDBILL." Any printed or written material, excluding newspapers, which advertises for sale any commodity or thing or event of any kind.
   "HAZARDOUS WASTES." Shall have the same meaning as defined by the Kentucky Revised Statues Chapter 224.
   "HEAVY USER CONTAINER." A steel container, with lid, that is designed for near loading collection.
   "INDUSTRIAL WASTES." The waste products of canneries, slaughterhouses, packing plants, large quantities of condemned food products, industrial wastes from brick, concrete block, roofing shingle or tile plants, debris and wastes accumulated from land clearings, excavating, building, rebuilding and altering of buildings, structures, roads, streets, sidewalks, or parkways by an owner or contractor.
   "LITTER." All solid wastes including, but not limited to, containers, packages, wrappings, printed matter or other material thrown or deposited as herein prohibited, but not including the wastes of the primary processes of mining, logging, saw milling, farming or manufacturing. Litter shall also mean any liquid such as oil or anti-freeze dumped or drained onto a city street, alley etc.
   "LITTER RECEPTACLE." Those containers used to deposit litter.
   "MEDICAL WASTE." Waste generated from any medical use, particularly that involving human tissue and fluids.
   "MULTIFAMILY STRUCTURE." Any building containing more than one (1) living unit.
   "OCCUPANT." Any person living and/or sleeping in a dwelling unit or having possession of a space within a building.
   "OWNER." Any person, agent, operator, firm, or corporation having a legal or equitable interest in the property; or recorded in the official records of the state, county or municipality as holding title to the property; or otherwise having control of the property, including the guardian of the estate of any such person, and the executor or administrator of the estate of such person if ordered to take possession of real property by a court.
   "PERSON." An individual, corporation, partnership or any other group acting as a unit.
   "PRIVATE PROPERTY." Any property not publicly owned or held out for use by the public.
   "PUBLIC PLACE." Any area that is used or held out for use by the public whether owned or operated by the public or private interests.
   "RUBBISH." Combustible and noncombustible waste materials, except garbage, and the term shall include the residue from the burning of wood, coal, coke, and other combustible materials, paper, rags, cartons, boxes, wood, excelsior, rubber, leather, tin cans, metals, mineral matter, glass, crockery and dust and other similar materials.
   "STREET." Synonymous with and includes any highway, road, alley, collector, local, arterial or freeway within the political subdivision.
   "STRUCTURE." That which is built or constructed, including without limitation because of enumeration, buildings for any occupancy or use whatsoever, fences, signs, billboards, fire escapes, chute escapes, railings, water tanks, towers, open grade steps, sidewalks or stairways, tents or anything erected and framed of component parts which is fastened, anchored or rests on a permanent foundation or on the ground.
   "SWEEP OUTS." Any collection of debris, resulting from cleanup operations, that is deposited in or around a public place.
   "TOTER." A large (90) gallon residential receptacle for the acceptance of garbage or refuse.
   "VEHICLE." Includes every device capable of being moved upon a public street and in, upon, or by which any person or property is or may be transported or drawn upon a public street, excepting devices moved by human or animal power or used exclusively upon stationary rail or tracks.
   "WATERCRAFT." Any boat, ship, vessel, barge or other craft.
   "YARD." An open unoccupied space on the same lot with a building extending along the entire length of street, or rear or interior lot line.
   "YARD WASTE." Organic material generated from yard maintenance activities such as lawn clipping, yard trimmings and tree branches.
