11-3-3: PRELIMINARY PLAT:
   A.   Application For Preliminary Plat:
      1.   Filing Application: The subdivider shall file with the Administrator copies of the completed subdivision application form and preliminary plat data as required by this title.
      2.   Certification By Administrator: Upon receipt of the preliminary plat application and data, the Administrator shall certify the application as complete and affix the date of acceptance thereon. Thereafter, the Administrator shall place said preliminary plat on the commission agenda for consideration at a regular meeting of the commission.
      3.   Review By And Recommendations Of Departments And Agencies: After certification of a preliminary plat application, the Administrator shall transmit one copy of the application and preliminary plat to all City departments and to such other agencies as have jurisdiction over or interest in the proposed subdivision for recommendation and review. Other agencies to which preliminary plats may be referred include South Central Public Health District, Idaho Utilities Commission, commissions of other governing bodies having joint jurisdiction, appropriate utility companies, Blaine Soil Conservation District, State Highway Department, and such other departments or agencies as the Administrator deems necessary in order to carry out the full extent of this title.
      4.   Review By Administrator: The Administrator shall review the preliminary plat application and data as well as the recommendations received from the various departments and agencies to ensure that said application and plat are in conformance with all applicable rules and regulations. The Administrator shall report to the commission.
   B.   Contents Of Plat: The preliminary plat, together with all application forms, fees, title insurance reports, deeds, maps, and other documents and information reasonably required by the Administrator, shall constitute a complete subdivision application. The preliminary plat shall be drawn to scale of not less than one inch equals one hundred feet (1" = 100') and shall show the following:
      1.   The scale, north point and date.
      2.   The name of the proposed subdivision, which shall not be the same or confused with the name of any other subdivision in Blaine County.
      3.   The name and address of the owner of record, the subdivider, and the engineer, surveyor, or other person preparing the plat.
      4.   Legal description of the area platted.
      5.   The names of all adjacent subdivisions, and the intersection boundary lines of adjoining subdivisions and parcels or property, together with a complete list of the owners of record of all property within three hundred feet (300') of the exterior boundary lines of the property.
      6.   A contour map of the subdivision with contour lines having a maximum interval of five feet (5') to show the configuration of the land based upon the U.S. Geodetic Survey data, and other data approved by the City Engineer.
      7.   The scaled location of existing buildings, water bodies and watercourses and location of the adjoining or immediately adjacent dedicated streets, roadways, and easements, public and private.
      8.   Boundary description and the area of the tract.
      9.   Existing zoning of the tract.
      10.   The proposed location of street rights-of-way, lots and lot lines, and easements, including all approximate dimensions and including all proposed lot and block numbering and proposed street names.
      11.   The location, approximate size, and proposed use of all land intended to be dedicated for public use or for common use of all future property owners within the proposed subdivision.
      12.   The location, size, and type of sanitary and storm sewers, water mains, culverts, and other surface or subsurface structures existing within or immediately adjacent to the proposed sanitary or storm sewers, water mains, and storage facilities, street improvements, street lighting, curbs and gutters, and all proposed utilities.
      13.   The direction of drainage flow and approximate grade of all streets.
      14.   The location of all drainage canals and structures, the proposed method of disposing of runoff water, and the location and size of all drainage easements relating thereto, whether they are located within or outside of the proposed plat.
      15.   All percolation tests and/or exploratory pit excavations required by State health authorities.
      16.   A copy of the provisions of the Articles of Incorporation and Bylaws of the Homeowners' Association and/or condominium declarations to be filed with the final plat of the subdivision.
      17.   Vicinity map drawn to approximate scale showing the location of the proposed subdivision in reference to existing and/or proposed arterial and collector streets.
      18.   The boundaries of the floodplain, floodway, and Avalanche Zoning District shall be clearly delineated and marked on the preliminary plat.
      19.   Building envelopes shall be shown on each lot all or part of which is within a floodplain, floodway, or Avalanche Zone, or any lot that is adjacent to the Big Wood River or any tributary; or any lot, a portion of which has a slope of twenty five percent (25%) or greater; or upon any lot which will be created adjacent to the intersection of two (2) or more streets.
      20.   Lot area of each lot.
      21.   Existing mature trees and established shrub masses.
      22.   A current title report shall be provided at the time that the preliminary plat is filed with the Administrator, together with a copy of the owner's recorded deed to said property.
      23.   Three (3) copies of the entire preliminary plat shall be filed with the Administrator.
   C.   Commission Action:
      1.   Consideration by the commission of a subdivision application and data shall take place at a regularly scheduled commission meeting, unless a special meeting of the commission is requested by the subdivider and granted by the commission. At that meeting, the commission shall do the following:
         a.   Hold a duly noticed public hearing on all subdivision applications.
         b.   After the public hearing, review the preliminary plat and supporting data, testimony of the subdivider, and the public, and approve, approve with specific conditions, or deny the preliminary plat. If the preliminary plat is denied, the reasons for such action shall be stated in writing, and a copy signed by the Administrator attached to one copy of the preliminary plat shall be returned to the applicant.
      2.   Upon approval of a preliminary plat, the Administrator shall transmit to the Council the subdivision application, preliminary plat, any other data and a copy of the commission findings and report.
   D.   Council Action: Submission of a preliminary plat upon approval by the commission to the Council shall be mandatory. The Council shall consider the subdivision application at a duly noticed public hearing. The subdivider, at his request, shall be entitled to at least one continuance. The Council shall consider the preliminary plat, subdivision application and data, the report and recommendations of the commission, and shall hear testimony of the subdivider and any witnesses in his behalf, and testimony of representatives of the commission, and any witnesses including interested citizens. Upon conclusion of its consideration of the preliminary plat, the Council shall approve, conditionally approve, or deny the plat and make findings consistent with law and this title. Upon approval of the preliminary plat by the Council, the subdivider shall prepare required improvement design plans in accordance with this title and additional condition(s) imposed by the Council. Upon approval of the improvement designs by the City Engineer, the subdivider shall commence construction on the required improvements. (Ord. 91-01, 12-2016)
