3-2-12: CATERING PERMIT:
   A.   Permit Authorized: Any person holding a valid Municipal alcoholic liquor by the drink, beer or wine license may obtain a catering permit to sell alcoholic liquor or beer or wine or any combination thereof, based upon the type of license which the applicant possesses, from the City Clerk pursuant to Idaho Code section 23-934A.    B.   Application For Permit: The retailer shall file an application with the City Clerk upon a form supplied by the City Clerk at least five (5) days prior to first proposed day of use of the permit. (Ord. 2005-12, 6-23-2005)
   C.   Location: The permit shall be issued to the retailer for a specified location, which location shall meet all of the requirements for a premises to be issued a Municipal alcoholic liquor by the drink, beer or wine license under this chapter and the laws of the State of Idaho.    D.   Fee Required: The catering permit fee shall be paid to the City by the retailer at the time of filing the application for said permit.
   E.   Issuance Or Denial Of Permit; Term:
      1.   The permit shall be issued for a period not to exceed three (3) consecutive days.
      2.   The City Clerk, upon advice of the City Marshal, may deny an application for failure of the applicant to provide the required information or for good cause with regard to the proposed location of the event to be catered. If an application is denied by the City Clerk, the reasons therefor shall be given to the applicant in writing, and the application fee shall be returned less the expenses for administration and costs of investigation incurred. An applicant denied a catering permit may appeal that decision to the City Council within ten (10) days of the Clerk's written decision by filing a written notice of appeal stating the grounds of such appeal with the City Clerk.
   F.   Conditions Of Permit: A catering permit shall be valid only for the specific location for which it is issued and is nontransferable. (Ord. 2005-12, 6-23-2005)
   G.   Compliance With State And City Laws: The sale and distribution of alcoholic liquor by the drink, beer and wine under a catering permit shall be subject to all the laws, ordinances, rules and regulations of the State of Idaho and the City of Bellevue with regard thereto.
