9-2-4: CONSTRUCTION STANDARDS AND DESIGN CRITERIA:
   A.   Minimum Standards: The design criteria, standards, specifications and standard drawings set forth in this section are hereby adopted as the minimum standards for permit application approval and construction and other work undertaken pursuant to this chapter within the City. Said criteria, standards, specifications and standard drawings apply to all construction, repair, improvement, and other activities for which a permit is required under subsection 9-2-2B of this chapter.
      1.   Street Construction Permit Standards: The design criteria, standard specifications, standard drawings, and additional requirements for the construction, reconstruction, repair, replacement and improvement of all streets and roadways, public or private, or any portion thereof, are set forth in appendix A entitled City of Bellevue, Idaho Street Construction Standards, which is on file with the City, and subsequent amendments thereto.
      2.   Public Pathway Construction Permit Standards: The design criteria, standard specifications, standard drawings and additional requirements for bicycle paths, equestrian paths and other public pathways are set forth in the Blaine County Bikepath and Public Pathway Construction Standards, and subsequent amendments thereto, hereby adopted by reference.
      3.   Street Excavation Permit Standards: The design criteria, standard specifications, standard drawings and additional requirements for any digging in, excavation, trenching or other disturbance to the surface or subsurface of any street, public or private, or public right-of-way, or any portion thereof, are set forth in appendix A, incorporated herein by reference and which is on file with the City, and subsequent amendments thereto.
      4.   Encroachment Permit Applications And Standards:
         a.   All encroachment permit applications shall be submitted to the Common Council for review and final decision to approve, approve with conditions or deny same. The Common Council may require such information, plans, engineering reports, and studies as it reasonably deems appropriate to properly consider such application. Approval or denial of an encroachment permit application shall be in the sound discretion of the Common Council. The Common Council shall consider and review each application upon the following standards, criteria and factors:
            (1)   Whether or not the proposed improvement will benefit the City and inhabitants thereof;
            (2)   The need for said improvement and any services provided thereby to the City and inhabitants thereof;
            (3)   That there will be no detrimental effects from such improvement upon the public health, safety and/or welfare of the City and/or inhabitants;
            (4)   That there are no alternative locations, routes and methods of construction for the proposed improvements that will eliminate potential adverse effect(s) therefrom or conflict(s) with future infrastructure improvements by the City; and
            (5)   Such other factors as the Common Council may deem appropriate based upon the particular circumstances of each encroachment application to ensure that the requested encroachment and the permit, if any, issued therefor promotes and is not detrimental to the health, safety and/or welfare of the City or inhabitants thereof.
         b.   The Common Council may attach reasonable conditions upon the issuance of an encroachment permit to protect the health, safety and/or welfare of the City or inhabitants thereof.
      5.   Special Conditions: Other reasonable criteria, specifications and drawings may be required for special situations or improvements as determined by the City Engineer, and all such special criteria, standard specifications and drawings shall be approved by the City Engineer.
      6.   Other Improvement Standards: If an improvement is proposed for which no standards are set forth herein, the standards of the Idaho Department of Transportation, or other State agency having standards therefor, including subsequent amendments thereto, are hereby adopted by reference and incorporated herein by reference. Standards for construction of sidewalks, curbs and gutters shall be pursuant to a specific plan approved by the City Engineer consistent with the existing Main Street improvements.
   B.   Amendments To Standards: Amendments and additions to each of the appendices on file with the City may be adopted by resolution of the City Council. (Ord. 98-06, 2-26-1998)
