A. Connection Required: Every parcel of land or premises within the boundaries of the City, improved for residential occupancy and occupied or used by any person, or for a commercial, industrial, business, governmental, recreational, or other use, shall be connected to the public water system. All charges associated with the laying of pipe from the home or facilities to be served by the City's mains and all other costs incurred in connecting to said public water system shall be borne by the property owner. All such connections to the public water system mains shall be properly designed and constructed in conformity with requirements specified by the City. It shall be unlawful for any person to construct, use or maintain any well unless otherwise approved by the Council, Idaho Department of Water Resources, and South Central Public Health District for areas of land located within the City limits such as, but not limited to, lands located at the west boundary City limits adjacent to Lower Broadford Road and the sixty one (61) acre parcel owned by the City, located at the east boundary City limits adjacent to Slaughterhouse Road. B. Permit To Connect; Capacity Of System:
1. It shall be unlawful to uncover, make any opening into, use, install, connect to, repair or alter any portion of the public water system or any portion or appurtenance thereof or to tap onto or connect to any public water system line without having first obtained from the City a permit. A written application for a connection to the public water system shall be made at the Office of the City Clerk, and no such connection shall be made without a valid permit having been issued by the Water Superintendent.
2. A water connection permit application shall include an application form provided by the City, plans of the proposed work, and payment of all applicable fees. In addition, in applicable circumstances, prior to issuance of the water connection permit, the applicant shall obtain a street excavation permit and post a bond for street restoration, which work shall be completed within thirty (30) days of the issuance of the water connection permit. At the time of filing the application for the water connection permit, the applicant shall pay the City the water connection permit fee, water system capitalization fee, and all other fees required by this chapter.
3. If, in the judgment and discretion of the Common Council, water wells, storage tanks, distribution lines or other facilities have reached capacity, or the granting of permits for further and additional water to the public water system would result in a lack of capacity of said system or any significant portion thereof, the City may refuse to accept applications for, or issuance of, any water permits for connections to said system until the public water system shall have adequate and satisfactory capacity to supply the City.
C. Permit Limitations:
1. Except for existing structures, no water connection permit shall be issued to any person until a valid building permit has been issued for the building or structure for which a water connection is contemplated. A copy of the building permit shall be submitted by the applicant to and filed with the Water Superintendent.
2. The existence of a water connection permit shall not permit any work for which the street excavation permit is required by the City. Streets, sidewalks, alleys and other public property disturbed in the course of the work shall be restored in accordance with the street standards ordinance at the applicant's expense.
3. No connection shall be made to the Municipal water system between October 15 and April 15 unless otherwise approved by the Water Superintendent (WSI).
D. Utility Payment Agreement Required: No connection of any kind to a public water line or the public water system shall be made nor shall any City water be permitted to flow through such connection except pursuant to an approved utility payment agreement, signed by the property owner or legal representative, issued by the City as required under this chapter. In the event that the City does not make the water connection, the City may reject any material or workmanship for cause, and upon such order, rejected material shall be removed and replaced with approved material. Disapproved workmanship shall cause the removal and replacement of all materials involved, including appurtenances, excavation, backfilling and other items. The City may require backflow prevention devices on service lines serving fire sprinklers, standpipes and similar uses where there is a risk of contamination from water backflow.
E. Plumber Requirements:
1. Except for City personnel, it shall be unlawful for any person not having a current and valid State of Idaho plumber's license or public works license to connect to, repair, alter or work on any public water line.
2. No person without a valid State plumber permit shall make any connection with, or opening into, or otherwise alter any portion of the public water system or appurtenance thereto, except for work done by the City Water Department and personnel. (Ord. 2010-06, 9-23-2010)
